2	Despite the death of her husband (Deputy Chief of Staff of the Syrian regime), the family link between Ms al-Assad and her brother is sufficient for the Council to be able to regard her as being linked to the leaders of Syria	Malgrado il decesso del coniuge (vice capo di stato maggiore del regime siriano), il legame familiare che unisce la sig.ra Al Assad a suo fratello è sufficiente affinché il Consiglio possa ritenerla legata ai dirigenti della Siria
3	Ms Bushra al-Assad (or Bouchra Al Assad) is the sister of Mr Bashar al-Assad, President of the Syrian Arab Republic, and was married to Mr Assef Shawkat, Deputy Chief of Staff of the Syrian regime, until his death.	La sig.ra Bouchra Al Assad è la sorella del sig. Bashar Al Assad, presidente della Repubblica Araba di Siria, ed è stata coniugata con il sig.Asif Shawkat, vice capo di stato maggiore del regime siriano, fino al decesso dello stesso.
4	In the context of the restrictive measures taken against Syria, the Council considered Ms al-Assad to be benefiting from and associated with the Syrian regime on account of the close personal relationship and intrinsic financial relationship to the Syrian President and other core Syrian regime figures.	Nell’ambito delle misure restrittive adottate nei confronti della Siria, il Consiglio ha ritenuto che la sig.ra Al Assad, date le strette relazioni personali e la relazione finanziaria indissociabile con il presidente siriano e con altre figure centrali del regime siriano, tragga vantaggio da tale regime e sia ad esso associata.
5	The Council therefore entered her name on the list of persons subject to restrictive measures, so that the funds she holds in the EU were frozen and she was prohibited from entry into, or transit through, the territory of the Member States of the EU.	Il Consiglio ha dunque inserito il suo nome nell’elenco delle persone interessate dalle misure restrittive, cosicché i capitali che essa possiede nell’Unione sono stati congelati e le è stato vietato l’ingresso o il transito nel territorio degli Stati membri dell’Unione.
6	Ms al-Assad claims annulment of the acts relating to her inclusion in the list.	La sig.ra Al Assad chiede l’annullamento degli atti concernenti il suo inserimento nell’elenco.
7	By its judgment delivered today, the General Court dismisses that application.	Con la sentenza odierna, il Tribunale respinge tale domanda.
8	The General Court finds, first of all, that the Council complied with its obligation to state reasons.	Il Tribunale constata anzitutto che il Consiglio ha ottemperato all’obbligo di motivazione cui è tenuto.
9	The Council’s statement of reasons (personal and family ties to the Syrian regime) is sufficient to enable the reason for Ms al-Assad’s entry on the list of persons subject to restrictive measures to be understood.	La motivazione fornita dal Consiglio (legami personali e familiari con il regime siriano) è infatti sufficiente per comprendere la ragione alla base dell’inserimento della sig.ra Al Assad nell’elenco delle persone interessate dalle misure restrittive.
10	Next, the General Court finds that when the restrictive measures were adopted, the Council did not infringe Ms al-Assad’s rights of defence or her right to effective judicial protection.	Il Tribunale rileva poi che, nell’adottare le misure restrittive, il Consiglio non ha violato né i diritti della difesa né il diritto a una tutela giurisdizionale effettiva della sig.ra Al Assad.
11	Following her entry on the list, Ms al-Assad was informed of the grounds for her designation and invited to submit observations.	Infatti, successivamente al suo inserimento nell’elenco, la sig.ra Al Assad è stata informata riguardo ai motivi dell’indicazione del suo nome ed è stata invitata a presentare le proprie osservazioni.
12	The fact that that notification occurred after her initial listing cannot be regarded in itself as an infringement of the rights of the defence.	La circostanza che tale comunicazione sia avvenuta dopo il primo inserimento nell’elenco non può essere considerata, di per sé, quale violazione dei diritti della difesa.
13	Prior notification of the grounds would be liable to jeopardise the effectiveness of the fund-freezing measures, which must have a surprise effect and apply immediately.	La previa comunicazione dei motivi potrebbe compromettere l’efficacia delle misure di congelamento che devono invece essere dotate di un effetto sorpresa e applicarsi con effetto immediato.
14	The Council was not, therefore, required to hear Ms al-Assad prior to her initial listing or even before adopting subsequent acts (in which the Council did not admit any new evidence).	Pertanto, il Consiglio non era tenuto a sentire la sig.ra Al Assad anteriormente al suo primo inserimento e neppure prima dell’adozione degli atti successivi (giacché in tali atti il Consiglio non aveva accolto alcun elemento nuovo).
15	Lastly, the General Court notes that Ms al-Assad has had the opportunity over several months to challenge the evidence justifying her initial and continued inclusion in the list.	Infine, il Tribunale rileva che la sig.ra Assad ha avuto l’occasione nel corso di più mesi di contestare gli elementi a giustificazione del suo inserimento e del suo mantenimento nell’elenco.
16	The General Court also finds that the Council was fully entitled to presume that persons whose ties to members of the Syrian regime are established may be regarded as supporting the regime or benefiting from it and, therefore, as being associated with it.	Il Tribunale constata inoltre che il Consiglio ha potuto legittimamente presumere che le persone i cui legami con taluni membri del regime siriano risultano provati sostengano il regime o ne traggano vantaggio e vi siano dunque associate.
17	That applies in the case of Ms al-Assad, despite the death of her husband and the overly vague nature of the Council’s reference to her relationship with ‘other core Syrian regime figures’.	È quanto avviene nel caso della sig.ra Al Assad, nonostante il decesso del suo coniuge e il carattere troppo vago del riferimento operato dal Consiglio alle sue relazioni con «altre figure centrali del regime siriano».
18	According to the General Court, the mere fact that Ms al-Assad is the sister of the Syrian President is sufficient for the Council to be able to regard her as being linked to the leaders of Syria, particularly since it is well known that power has traditionally been exercised on a family basis in Syria, which the Council was entitled to take into account.	Infatti, secondo il Tribunale, il solo fatto che la sig.ra Al Assad sia la sorella del presidente siriano è sufficiente affinché il Consiglio possa ritenerla legata ai dirigenti della Siria, tanto più che l’esistenza in tale paese di una tradizione di gestione familiare del potere è un fatto notorio del quale il Consiglio poteva tenere conto.
19	The General Court finds that if the restrictive measures were adopted only against the leaders of the Syrian regime, the Council’s objectives could be defeated, since the leaders concerned could easily circumvent those measures through their relatives.	A tale proposito il Tribunale constata che se le misure restrittive avessero riguardato soltanto i dirigenti del regime siriano, gli obiettivi perseguiti dal Consiglio avrebbero potuto essere vanificati, dal momento che detti dirigenti potrebbero facilmente eludere le suddette misure attraverso i loro congiunti.
20	The General Court also notes that the Council produced extracts from internet sites indicating Ms al-Assad’s political role, which confirms that she is associated with the Syrian regime.	Il Tribunale rileva altresì che il Consiglio ha prodotto estratti di siti Internet che dimostrano il ruolo politico della sig.ra Al Assad, circostanza questa che conferma la sua associazione al regime siriano.
21	The General Court rejects Ms al-Assad’s arguments that, as a non-working mother, she does not perform any public or economic function, and that her children are now at school in the United Arab Emirates.	Il Tribunale respinge gli argomenti della sig.ra Al Assad in base ai quali, essendo casalinga, essa non svolge alcuna funzione pubblica o economica e che i suoi figli frequentano ora le scuole negli Emirati Arabi Uniti.
22	The General Court finds that the fact that Ms al-Assad’s children are at school in the United Arab Emirates is not sufficient for her to be regarded as having dissociated herself from the Syrian regime and as having been forced to flee the country.	Al riguardo il Tribunale rileva che la circostanza che i figli della sig.ra Al Assad frequentino le scuole negli Emirati Arabi Uniti non è sufficiente per far ritenere che la stessa si sia dissociata dal regime siriano e sia dovuta fuggire dal paese.
23	There may be many other reasons for a change in Ms al-Assad’s residence, such as the deterioration of the security situation in Syria.	Invero, l’eventuale cambiamento di residenza della sig.ra Al Assad può trovare una spiegazione in numerose altre ragioni, quali l’insicurezza crescente in Siria.
24	Lastly, the General Court recognises that the restrictive measures restrict Ms al-Assad’s right to property and affect her private life, since she does not have free enjoyment of her possessions and her freedom of movement is limited.	Infine, il Tribunale riconosce che le misure restrittive limitano il diritto di proprietà della sig.ra Al Assad e pregiudicano la sua vita privata, dal momento che essa non può godere liberamente dei propri beni e che la sua libertà di movimento è limitata.
25	However, given the overriding importance of the protection of civilian populations in Syria and the derogations provided for by the contested decisions (periodic review of the decision by the Council), the General Court holds that the restrictions are not disproportionate.	Tuttavia, data la fondamentale importanza della tutela delle popolazioni civili in Siria e le deroghe previste dalle decisioni impugnate (riesame periodico della decisione da parte del Consiglio), il Tribunale dichiara che le restrizioni non sono sproporzionate.

27	An appeal, limited to points of law only, may be brought before the Court of Justice against the decision of the General Court within two months of notification of the decision.	Contro la decisione del Tribunale, entro due mesi a decorrere dalla data della sua notifica, può essere proposta un’impugnazione, limitata alle questioni di diritto, dinanzi alla Corte.

29	An action for annulment seeks the annulment of acts of the institutions of the European Union that are contrary to European Union law.	Il ricorso di annullamento mira a far annullare atti delle istituzioni dell’Unione contrari al diritto dell’Unione.
30	The Member States, the European institutions and individuals may, under certain conditions, bring an action for annulment before the Court of Justice or the General Court.	A determinate condizioni, gli Stati membri, le istituzioni europee e i privati possono investire la Corte di giustizia o il Tribunale di un ricorso di annullamento.
31	If the action is well founded, the act is annulled.	Se il ricorso è fondato, l’atto viene annullato.
32	The institution concerned must fill any legal vacuum created by the annulment of the act.	L’istituzione interessata deve rimediare all’eventuale lacuna giuridica creata dall’annullamento dell’atto.
