1	European Commission takes decisive action against legal highs	Decisa azione della Commissione contro le nuove sostanze psicoattive
2	The European Commission today proposed to strengthen the European Union’s ability to respond to ‘legal highs’ – new psychoactive substances used as alternatives to illicit drugs such as cocaine and ecstasy.	La Commissione europea ha presentato oggi una proposta volta a rafforzare la capacità dell’Unione europea di rispondere alle «legal highs» — le nuove sostanze psicoattive utilizzate in alternativa alle droghe illecite quali cocaina ed ecstasy.
3	Under the rules proposed by the Commission today, harmful psychoactive substances will be withdrawn quickly from the market, without jeopardising their various legitimate industrial and commercial uses.	La proposta prevede che le sostanze psicoattive nocive siano rapidamente ritirate dal mercato, fermi restando i vari usi industriali e commerciali legittimi di tali sostanze.
4	The proposals follow warnings from the EU's Drugs Agency (the EMCDDA) and Europol about the scale of the problem and a 2011 report which found that the EU’s current mechanism for tackling new psychoactive substances needed bolstering (IP/11/1236).	L’iniziativa legislativa risponde alle allarmanti segnalazioni provenienti dall’Osservatorio europeo delle droghe e delle tossicodipendenze (OEDT) e dall’Europol circa la dimensione del problema e alle conclusioni di una relazione del 2011, secondo le quali è necessario rafforzare l’attuale meccanismo di lotta alle nuove sostanze psicoattive (IP/11/1236).
5	Today's proposal was presented by Vice-President Reding, in association with Vice-President Tajani and Commissioner Borg.	La proposta odierna è stata presentata dalla Vicepresidente Reding, assieme al Vicepresidente Tajani e al Commissario Borg.

7	With a borderless internal market, we need common EU rules to tackle this problem," said Vice-President Viviane Reding, the EU’s Justice Commissioner. 9	New psychoactive substances are a growing problem.	Le nuove sostanze psicoattive rappresentano un problema sempre maggiore;
10	The number of new psychoactive substances detected in the EU has tripled between 2009 and 2012.	il numero delle sostanze rilevate nell’UE è triplicato tra il 2009 e il 2012.

13	The substances are increasingly available over the internet and rapidly spread between EU countries: 80% of new psychoactive substances are detected in more than one EU country.	con sempre maggior frequenza le sostanze sono disponibili via Internet e si diffondono rapidamente da uno Stato membro all’altro, tanto che l’80% delle nuove sostanze psicoattive è stato riscontrato in più di uno Stato membro.
14	The young generation is most at risk:	I giovani sono i più esposti ai rischi insiti nelle citate sostanze:
15	a 2011 Eurobarometer on "Youth attitudes on drugs" shows that on average 5% of young people in the EU have used such substances at least once in their life, with a peak of 16% in Ireland, and close to 10% in Poland, Latvia and the UK.	Il sondaggio «Eurobarometro 2011 sul rapporto tra i giovani e gli stupefacenti» (Eurobarometer on “Youth attitudes on drugs”) mostra che, in media, il 5% dei giovani nell’UE ha fatto uso di tali sostanze almeno una volta, con un picco del 16% in Irlanda e di quasi il 10% in Polonia, Lettonia e Regno Unito.
16	These substances pose major risks to public health and to society as a whole (see Annex 2).	Queste sostanze comportano gravi rischi per la sanità pubblica e per la società nel suo complesso (cfr. allegato 2).
17	Consuming new psychoactive substances can be fatal.	Il consumo di nuove sostanze psicoattive può avere conseguenze mortali.
18	For instance, the substance 5-IT reportedly killed 24 people in four EU countries, in just five months, between April and August 2012. 19	4-MA, a substance which imitates amphetamine, was associated with 21 deaths in four EU countries in 2010-2012 alone.	La droga “4-MA”, una sostanza che imita l’amfetamina, sarebbe tra le concause di morte di 21 persone in quattro Stati UE nel solo periodo 2010-2012.

26	In particularly serious cases, the procedure will be shorter still as it will also be possible to withdraw substances immediately from the market for one year. 27	This measure will make sure the substance is no longer available to consumers while a full risk assessment is being carried out. 28	Under the current system, no temporary measures are possible and the Commission needs to wait for a full risk assessment report to be completed before making a proposal to restrict a substance. 30	The new system will allow for a graduated approach where substances posing a moderate risk will be subject to consumer market restrictions and substances posing a high risk to full market restrictions.	Il nuovo sistema consentirà un approccio commisurato ai potenziali rischi:le sostanze che presentano un rischio moderato saranno soggette a restrizioni nel mercato dei beni di consumo mentre le sostanze che presentano un livello di rischio elevato saranno bandite da tutti i mercati.
31	Only the most harmful substances, posing severe risks to consumers' health, will be submitted to criminal law provisions, as in the case of illicit drugs.	Solo nei confronti delle sostanze più nocive, che comportano gravi rischi per la salute dei consumatori, saranno introdotte norme di diritto penale, come nel caso delle droghe illecite.
32	Under the current system, the Union's options are binary - either taking no action at EU level or imposing full market restrictions and criminal sanctions.	Il sistema attuale prevede invece due sole opzioni: nessun intervento a livello dell’UE o bando totale delle sostanze dai mercati corredato di sanzioni penali.
33	This lack of options means that, at present, the Union does not take action in relation to some harmful substances.	La mancanza di alternative fa sì che, attualmente, l’Unione non interviene nei confronti di alcune sostanze nocive.
34	With the new system, the Union will be able to tackle more cases and deal with them more proportionately, by tailoring its response to the risks involved and taking into account the legitimate commercial and industrial uses.	Con il nuovo sistema l’Unione potrà affrontare un maggior numero di casi, con misure più proporzionate, adeguando i suoi interventi in funzione dei rischi connessi e tenendo conto dei legittimi usi industriali e commerciali.
35	The Commission proposals now need to be adopted by the European Parliament and by Member States in the Council of the European Union in order to become law. 39	In recent years, on average one new psychoactive substance was detected every week in the EU, and the numbers are expected to increase in the coming years. 40	Since 1997, Member States have detected more than 300 substances and their number tripled between 2009 and 2012 (from 24 in 2009 to 73 in 2012).	Dal 1997 gli Stati membri hanno scoperto oltre 300 sostanze, ad un ritmo triplicato tra il 2009 e il 2012 (da 24 nel 2009 a 73 nel 2012).
41	Under the existing EU instrument, Council Decision 2005/387/JHA, the Commission can propose to Member States that new drugs be subjected to criminal measures.	Nell’ambito dell’attuale strumento dell’UE, la decisione 2005/387/GAI del Consiglio, la Commissione può proporre agli Stati membri di sottoporre le nuove droghe a misure di carattere penale.
42	Thanks to this mechanism, 9 substances have been submitted to restriction measures and criminal sanctions.	Tale meccanismo ha permesso di sottoporre 9 sostanze a misure di restrizione e a sanzioni penali.
43	Most recently, in 2010, the Commission proposed and achieved an EU-wide ban on the ecstasy-like drug mephedrone (MEMO/10/646) and in early 2013 on the amphetamine-like drug 4-MA (IP/13/75).	Recentemente, nel 2010, la Commissione ha proposto ed ottenuto l’interdizione in tutta l’UE del mefedrone, una droga simile all’ecstasy (MEMO/10/646) e, all’inizio del 2013, della sostanza 4-MA, simile all’amfetamina (IP/13/75).
44	In June 2013 the Commission also proposed to ban the synthetic '5-IT' drug (IP/13/604).	Nel giugno 2013 la Commissione ha inoltre proposto di vietare la droga di sintesi “5-IT” (IP/13/604).
45	A 2011 report found that the current system has struggled to keep up with the large numbers of new substances emerging on the market. 46	It takes two years to submit a single substance to restrictive measures.	La procedura per sottoporre un’unica sostanza a misure restrittive richiede due anni.
47	Criminals can then circumvent the control measures through limited changes to the chemical structure of the substance which do not mitigate its serious harmful effects.	I criminali possono quindi eludere le misure di controllo apportando piccole modifiche alla struttura chimica della sostanza, senza attenuarne le gravi conseguenze per la salute.
48	In addition, the binary nature of the current system, criminal measures or no action, hinders the Union's ability to act. It lacks a range of effective options for control measures which allows swift, targeted action.	Inoltre, il carattere binario del sistema attuale (che prevede due sole opzioni: misure penali o nessun intervento) ostacola la capacità dell’Unione di agire, non permettendole di considerare opzioni efficaci per adottare misure di controllo rapide e mirate.
49	Today's proposals respond to persistent warnings from the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA) and Europol. They also respond to calls from the European Parliament and Member States (see 2011 Council conclusions) to update Council Decision 2005/387.	Le proposte odierne rispondono alle segnalazioni allarmanti provenienti dall’Osservatorio europeo delle droghe e delle tossicodipendenze (OEDT) e dall’Europol, così come alle richieste del Parlamento europeo e degli Stati membri (cfr.
