Obligatory electronic payment: the reactions of shopkeepers and service providers #tePOSsino

The M5S has always been in support of the SMEs.
Per questo attraverso una risoluzione in commissione Finanze abbiamo chiesto al Governo di:
This is why we have put forward a resolution to the Finance Committee to ask the Government to take the following actions:
1) fare in modo che fino al 30 giugno 2015 l’obbligo riguardi soltanto i soggetti con almeno 200mila euro di fatturato;
1) Up until 30 June 2015 the obligation must apply only to those whose turnover is at least 200 thousand euro;
2) escludere dal vincolo tutte le nuove attività per almeno due anni;
2) exclude all start-ups from the obligation for at least two years;
3) prevedere che i costi delle transazioni siano a carico delle banche.
3) lay down that the transaction costs are borne by the banks.
>>> Inoltre il M5S in Lombardia ha presentato una mozione, approvata dal Consiglio, che chiede che la Regione Lombardia si attivi presso il Governo per sospendere il provvedimento che rende obbligatorio il POS per le piccole imprese fino a quando i costi del servizio bancario non saranno in linea con la media europea
Furthermore the M5S in Lombardy has put forward a motion approved by the Council, asking the Region of Lombardy to work with the Government to suspend the obligation for the SMEs until the costs of banking services are on a par with European averages.
“Il 30 giugno 2014 è entrata in vigore la legge sul pos.
“The law setting out the obligation to have electronic payments came into force on 30 June 2014.
La norma è molto contradditoria e ha creato molta confusione, soprattutto alle categorie più colpite, che si dicono indignate.
The regulation is full of contradictions and it has created a lot of confusion, especially among those directly affected who are said to be outraged.
L’introduzione dei sistemi di pagamento elettronici era già stata disposta in un decreto del 2012, tenuta congelata fino ad oggi.
The 2012 decree already brought in electronic payment systems, but up until now it has not been applied.
Vediamo quali sono i punti essenziali della legge:
Let’s have a look at the essential points of the law:
1) Gli interessati al provvedimento sono i professionisti, gli artigiani e i piccoli esercenti (si contano circa 1,5 milione di persone) che hanno l’obbligo di munirsi del pos
1) Those to whom this measure applies are independent professionals, service providers and owners of small retail outlets (about 1.5 million people) that are obliged to have an electronic payment system.
2) I pagamenti superiori a 30 euro devono essere effettuati tramite carta di credito e bancomat ogni volta che il cliente lo richiede ma anche con bonifico e assegno
2) Payments above 30 euro have to be made using a credit or debit card if the customer requests that but payment by cheque or via bank transfer is also acceptable.
3) E’ stato calcolato che il pos costa di media 1200 – 1700 euro l’anno a carico del commerciante
3) It’s been estimated that electronic payments cost the merchant between 1200 – 1700 euro a year
4) Al momento non sono previste sanzioni a chi non accetta pagamenti con pos
4) At the moment there are no penalties applied to those not accepting electronic payments
5) Rimane invariata la possibilità di pagare in contanti fino a un limite massimo di 1000 euro
5) The possibility of making a cash payment of up to a maximum of 1000 euro has not changed
Il Segretario della CGIA Giuseppe Bortolussi si è già opposto a questa manovra e denuncia l’ingiustizia di un provvedimento che mira a mettere in difficoltà economica gli artigiani:
CGIA Secretary Giuseppe Bortolussi has already expressed his objection to this measure and he has denounced the injustice of a measure that will cause financial difficulties to service providers:
“Milioni d’imprese (…) sono costrette a sostenere dei costi inutili:
“Millions of companies (…) are obliged to carry unnecessary costs:
autotrasportatori, imprese di costruzioni che lavorano per il pubblico, aziende metalmeccaniche, tessili, dell’abbigliamento o della calzatura che lavorano in subfornitura;
self-employed drivers, construction companies working in the public sector, engineering companies, companies producing a range of goods from clothes to shoes that are sold on to other companies;
le imprese di pulizie che prestano servizio presso gli studi privati o negli enti pubblici e i commercianti all’ingrosso”.
cleaning companies working for small firms or public bodies; and then you have wholesalers”.
La norma sul pos è stata introdotta col fine di limitare l’evasione fiscale dei liberi professionisti e nel mirino ci sono soprattutto:
The obligatory electronic payment provision was brought in with the aim of countering tax dodging by freelance professionals and and it is especially targeted at:
idraulici, elettricisti, falegnami, antennisti, manutentori di caldaie e tutti gli artigiani che effettuano lavori “a casa della gente”.
plumbers, electricians, carpenters, aerial fitters, maintenance workers and all those carrying out work “in people’s homes”.
Il principio di applicazione di questa norma è basato sulla tracciabilità fiscale, ma allora viene da chiedersi che affidabilità hanno dei dati parziali, visto che non sono previste multe per chi non si adegua.
The reason for bringing in this regulation is to have traceability for tax purposes, but you might ask, what’s the point in having partial coverage as there are no fines for non-compliance.
Questa è la prima contraddizione evidente.
This is the first obvious contradiction.
La seconda riguarda invece le banche.
Whereas the second contradiction relates to the banks.

Yes, because as always, they are the ones that end up winning out.
Commercianti e artigiani contestano le commisioni bancarie, troppo alte rispetto il resto dell’Europa e del mondo.
Shopkeepers and service providers are challenging bank charges that are so much higher than those in the rest of Europeand in the rest of the world.
A quanto pare malcontenti e malumori non sono passati inosservati e il Ministro Federica Guidi ha convocato un incontro previsto per il 16 luglio.
It seems that upset and discontent has not gone unnoticed and Minister Federica Guidi has called a meeting to take place on 16 July.
Convocati il Ministero dello Sviluppo economico, il Ministero del Tesoro e il consorzio Bancomat.
The Ministry for Economic Development, the Ministry of Economy and Finances and the Bancomat Consortium are invited to attend.
