The children of the Congo

Presentation by Leopoldo Salmaso, an aid-worker who has been a Public Health expert in Tanzania since 1978
“Premesso che provo grande empatia con le coppie che si trovano bloccate con le loro adozioni in Congo, vorrei precisare alcuni punti, sconosciuti ai più:
“I would like to start off by saying that I feel a lot of empathy with the couples who are finding their path blocked when they try to adopt children in the Congo. I would like to explain a few things that a lot of people don’t know:
1) Nelle culture africane è INCONCEPIBILE che un bambino venga affidato ad estranei, per la semplice ragione che il concetto di FAMIGLIA è allargato non solo ai parenti anche più lontani, ma anche al clan, alla tribù, e in ultima istanza alla nazione intera.
1) In African cultures it’s INCONCEIVABLE for a child to be entrusted to the care of an outsider, and this is for the very simple reason that the concept of FAMILY is spread out not just to relatives, even quite distant relatives, but also to the clan and to the tribe, and in the final instance to the whole nation.
In molte lingue africane non esiste neppure un termine corrispondente al nostro “orfano”.
In many African languages, there is not even a term corresponding to “orphan”.
Spesso la “zia” si chiama “piccola madre” e per dire “zio” si dice “piccolo padre”.
Often the “aunt” is called “little mother” and the “uncle” is called “little father”
Di regola, i piccoli dopo i due anni sono affidati alla nonna paterna quasi a tempo pieno.
Normally, once a child is over 24 months, they are entrusted to the care of the paternal grandmother.
In ogni caso, anche il parente più lontano ha una serie di diritti/doveri sul piccolo, tanto da rendere praticamente impossibile, per qualsiasi tribunale, dichiarare l’adottabilità di un minore senza suscitare forte malcontento nella popolazione.
Anyway, even the most distant relative has a series of duties and rights in relation to the child. This makes it practically impossible for any tribunal to be able to declare that a child can be adopted, as this would cause a lot of discord among the people.
>>> 2) Le adozioni internazionali sono disciplinate dalla Convenzione dell’Aja, cui hanno aderito quasi tutti gli stati del mondo TRANNE quelli africani e musulmani, proprio per le ragioni culturali sopra esposte.
2) International adoptions are regulated by the Hague Adoption Convention. Nearly all the countries of the world have signed up to this APART FROM Islamic countries and countries in Africa.
Eccezioni che confermano la regola sono il Sudafrica e pochi stati affini (dove le leggi sono state fatte dai bianchi dominanti) e la Turchia (che notoriamente è il più laico dei paesi musulmani).
Exceptions to this rule are South Africa and a few similar States (where the laws were made by the dominant white population) and Turkey (which is well known to be the most secular of the Islamic countries).
3) Come la stragrande maggioranza degli stati africani la Repubblica Democratica del Congo non ha sottoscritto la Convenzione dell’Aja né un trattato bilaterale con l’Italia in tema di adozioni.
3) Like most countries in Africa, the Democratic Republic of the Congo has not signed up to the Hague Adoption Convention and neither has it signed a bilateral agreement on adoptions, with Italy.
Le poche pratiche che pure si fanno in Congo dipendono dai giudici locali, e sono spesso oggetto di forti contestazioni per le ragioni sopraddette.
The handful of adoptions that go ahead in the Congo are dependent on local judges and they are often subject to many disagreements for the reasons mentioned above.
Come se non bastasse, sempre più spesso spuntano da chissà dove parenti più o meno lontani, aizzati da avvocati-avvoltoi che dove vedono una pelle bianca vedono soldi facili.
And if that were not enough, relatives are always popping up from who knows where.They are relatives with varying degrees of closeness to the child, fished out by predatory lawyers who see white skin as a source of easy money.
4) La Convenzione dell’Aja stabilisce due priorità fondamentali:
4) The Hague Adoption Convention establishes two fundamental priorities:
primo: garantire l’interesse del bambino a rimanere nel proprio ambito familiare e culturale.
first: to guarantee the interests of the child in remaining within the ambit of their family and culture.
Secondo: combattere lo sfruttamento e la tratta dei bambini.
Second: to combat the exploitation and the trafficking of children.
L’adozione internazionale è riconosciuta come “ultima spiaggia” e infatti la convenzione stessa dichiara che l’adozione è nulla se non si è fatto tutto il possibile per garantire le due priorità sovraordinate.
International adoption is recognised as the “last resort“ and, in fact, the Convention itself says that the act of adoption is nullified unless everything possible has been done to guarantee the two priorities mentioned above.
5) La nostra Commissione per le Adozioni Internazionali ha il compito, fra l’altro, di certificare l’idoneità delle associazioni che offrono assistenza alle coppie desiderose di adottare un bambino straniero.
5) In Italy, one of the tasks of our Commission for Intercountry Adoption is to certify the eligibility of the associations that offer assistance to the couples that want to adopt a foreign child.
Un’associazione che coinvolga una coppia nell’adozione di un bambino in uno Stato che non ha aderito alla convenzione dell’Aja (o che non abbia almeno sottoscritto un trattato bilaterale con l’Italia) compie un atto temerario, assai rischioso sia per i bambini che per gli aspiranti genitori.
Any association that gets a couple involved in the adoption of a child in a country that has not signed up to the Hague Adoption Convention (or that has not even established with Italy a bilateral agreement on adoptions) is acting recklessly and this is risky for the children involved as well as for the people hoping to adopt.
Una simile associazione dovrebbe essere automaticamente dichiarata NON IDONEA.
Any organisation like that should be automatically declared NOT ELIGIBLE.
