We often see the “CE marking” on some of the products we buy, but what does it really mean?
I prodotti che acquistiamo recano spesso il “marchio CE”, ma qual è il reale significato di questo marchio?
Under the slogan “CE marking makes Europe’s market yours!”, the European Commission is carrying out an information campaign on the CE marking.
All’insegna dello slogan “Il marchio CE vi apre il mercato europeo!”, la Commissione europea conduce una campagna d’informazione in proposito.
The marking signals that a product is in compliance with all relevant EU legislation, making it eligible to be marketed and sold throughout the EU.
Il marchio CE effettivamente indica che un prodotto è conforme alla pertinente legislazione UE, ragion per cui può essere commercializzato e venduto in tutta l’UE.
By affixing the CE marking on a product, a manufacturer is declaring, on his sole responsibility, conformity with all relevant legal requirements, in particular those which ensure health, safety, and environmental protection.
Applicando il marchio CE su un prodotto un fabbricante dichiara, unicamente sotto la propria responsabilità, che esso risulta conforme a tutte le prescrizioni di legge applicabili, in particolare a quelle in tema di salute, sicurezza del prodotto e protezione ambientale.
Legal and economic repercussions of non-conformity abuses are so great that it will deter the vast majority of legitimate businesses from not respecting these laws.
Le ripercussioni giuridiche ed economiche di un mancato rispetto della normativa vigente sono tali da produrre un effetto deterrente sulla stragrande maggioranza delle imprese.

However, this confidence is also dependent on the reliability of the system on which the CE mark is based.
La fiducia del pubblico, però, è in funzione dell’affidabilità del sistema su cui si basa il marchio CE.
Thus it will boost consumer’s confidence and benefit producers and distributors.”

Not all products sold in the EU need to bear CE marking.
Non tutti i prodotti venduti nell’UE devono recare il marchio CE.
It applies to approximately 23 different product categories, such as toys, electrical products, machinery, personal protective equipment and lifts.
Esso si applica a circa 23 categorie diverse di prodotti, come i giocattoli, gli apparecchi elettrici, le macchine, i dispositivi di protezione personale e gli ascensori.
CE marking does not indicate that a product was made in the EEA, but merely states that the product is assessed before it is placed on the market and therefore satisfies the legislative requirements (e.g. a harmonised safety level).
Il marchio CE non sta ad indicare che un prodotto è stato fabbricato nel SEE, bensì indica che il prodotto è stato verificato prima di essere immesso sul mercato e soddisfa quindi le disposizioni di legge (ad esempio, un livello armonizzato di sicurezza).
It means that the manufacturer has verified that the product complies with all relevant essential requirements (e.g. health and safety requirements) of the applicable directive(s),or had it examined by a notified conformity assessment body.
Esso implica che il fabbricante ha verificato che il prodotto sia conforme a tutti i pertinenti requisiti di base (ad esempio, in materia di salute e sicurezza) delle direttive applicabili ovvero che lo ha fatto esaminare da un organismo notificato di valutazione della conformità.
For products manufactured in the EU, it is the manufacturer’s responsibility to carry out the conformity assessment, to set up the technical file, to issue the EC declaration of conformity and to affix CE marking on a product.
Per gli articoli prodotti nell’UE spetta al fabbricante eseguire la valutazione di conformità, redigere la scheda tecnica, rilasciare la dichiarazione CE di conformità e applicare il marchio CE su un prodotto.
Distributors must verify the presence of both the CE marking and the necessary supporting documentation.
I distributori devono verificare la presenza sia del marchio CE sia della necessaria documentazione di supporto.
For products imported from a third country, the importer has to verify that the manufacturer outside the EU has undertaken the necessary steps and that the documentation is available upon request.
Per i prodotti importati da un paese terzo l’importatore deve accertare che il fabbricante avente sede al di fuori dell’UE abbia fatto il necessario in tal senso e che la relativa documentazione sia disponibile a richiesta.
The CE marking makes life easier for enterprises and national authorities:
Il marchio CE semplifica la vita alle imprese e alle autorità nazionali:
– For European industry, the marking provides EU enterprises with access to the entire single market without having to acquire 27 individual approvals from national authorities, thereby reducing the cost and burden of conformity while maintaining high standards.
– per l’industria europea, il marchio dà alle imprese dell’UE un accesso all’intero mercato unico senza dover acquisire 27 approvazioni individuali dalle autorità nazionali, riducendo così i costi e gli oneri della certificazione di conformità e mantenendo nel contempo standard elevati;
– For national authorities, it facilitates controls to be handled by each agency at a time when the range of goods available on the EU market is growing exponentially, without compromising standards.
– per le autorità nazionali, esso agevola i controlli che devono essere effettuati dalle singole agenzie allorché la gamma di beni disponibili sul mercato dell’UE cresce in modo esponenziale, senza per questo compromettere gli standard.
However, strengthening the control of notified bodies and improving market surveillance is improving the reputation of the CE Marking and increasing consumers’ trust.
Tuttavia, rafforzare il controllo degli organismi notificati e migliorare la sorveglianza del mercato significa far crescere la reputazione del marchio CE e la fiducia dei consumatori.
With the entry into force of the revised internal market package of legislation for goods, the role and credibility of CE marking has been reinforced (see MEMO/10/257).
Con l’entrata in vigore del pacchetto legislativo riveduto attinente al mercato interno dei beni, il ruolo e la credibilità del marchio CE si sono rafforzati (cfr. MEMO/10/257).
The procedures, measures and sanctions applying to counterfeiting/abuse of the CE marking are laid down in the respective Member State’s national administrative and penal law.
Le procedure, i provvedimenti e le sanzioni che si applicano in caso di contraffazione/abuso del marchio CE sono statuiti nel diritto amministrativo e penale dei rispettivi Stati membri.
Depending on the seriousness of the offence, economic operators may be liable to a fine and in some circumstances, imprisonment.
A seconda della gravità del dolo, agli operatori economici può essere comminata una sanzione pecuniaria e, in certe circostanze, una pena detentiva.
However, if the product is not regarded as an imminent safety risk, the manufacturer may be given a second opportunity to ensure that the product is in conformity with the applicable legislation, before being obliged to take the product off the market.
Se però il prodotto non è ritenuto configurare un rischio imminente per la sicurezza, il fabbricante può ricevere una seconda opportunità per rendere il prodotto conforme alla legislazione in vigore prima di essere obbligato a ritirarla dal mercato.
The communication campaign consists of, among other initiatives, thirty CE marking educational events/seminars for economic operators, professional associations, consumers’ associations and journalists.
La campagna di comunicazione consiste, tra altre iniziative, in una trentina di eventi/seminari educativi sul marchio CE destinati agli operatori economici, alle associazioni di categoria, alle associazioni dei consumatori e ai giornalisti.
