Why did the Commission adopt emergency measures?

Scientists discovered recently that the stock was doing a lot worse than expected.
Di recente, alcuni scienziati hanno scoperto che lo stock si trova in condizioni molto peggiori del previsto.

It has been below safe biological limits for two years and will stay there at least in the medium term even without any fishing.
Da due anni infatti si trova al di sotto dei limiti biologici di sicurezza e tale situazione non cambierà, perlomeno a medio termine, anche se l’attività di pesca cessasse del tutto.

The stock is widely distributed in the Baltic Sea and all Member States in the region participate in the fishery.
Lo stock è ampiamente distribuito nel Mar Baltico e tutti gli Stati membri della regione partecipano all’attività di pesca.

Earlier this year, the Commission had invited Member States to take action. Some did, others did not.
All’inizio dell’anno la Commissione ha invitato gli Stati membri ad adottare provvedimenti al riguardo, ma solo alcuni di essi lo hanno fatto.

Faced with the urgency and in light of the latest scientific assessment, the Commission has decided to take action at EU level.
A fronte dell’urgenza della situazione e alla luce delle più recenti valutazioni scientifiche, la Commissione ha deciso dunque di intervenire a livello europeo.

So what are these emergency measures?
In cosa consistono le misure di emergenza?

Targeted cod fishing is prohibited in those areas where eastern Baltic cod is found, meaning ICES areas 24-26.
La pesca mirata del merluzzo è vietata nelle zone in cui è presente il merluzzo bianco del Baltico orientale, ovvero le zone CIEM 24-26.

Conversely, areas where there is little eastern Baltic cod are not subject to the prohibition, i.e.areas 27-32 and the shallow coastal waters of area 24.
Le zone in cui vi è una scarsa presenza di merluzzo bianco del Baltico orientale, come le zone 27-32 e le acque costiere poco profonde della zona 24, non sono soggette a tale divieto.

We have proposed proportionate measures with derogations for by-catches in two types of fisheries.
Sono state proposte misure proporzionate, con deroghe per le catture accessorie di due tipi di attività di pesca.

>>>  The pelagic fisheries have very small unavoidable by-catches of cod, which cannot be sorted on board.

Therefore, these fisheries have a derogation from the prohibition, because otherwise they would not be able to fish at all.

Similarly, small-scale coastal fisheries that use passive gears to target mostly flatfish like plaice, flounder and turbot, have some by-catches of cod.
Analogamente, le attività di piccola pesca costiera che utilizzano attrezzi passivi per pescare principalmente pesci piatti, come la passera di mare, la passera pianuzza e il rombo chiodato, comportano alcune catture accessorie di merluzzo.

They should be allowed to land some by-catches and, hence, have a derogation from the prohibition.
Le navi dovrebbero essere autorizzate a sbarcare una piccola quantità di catture accessorie, e quindi beneficiare di una deroga al divieto.

However, they should strive to minimize such by-catches and the overall fishing effort shouldn’t increase.
Tuttavia, è necessario che gli operatori si impegnino per limitare le catture accessorie e che lo sforzo di pesca globale non aumenti.

Therefore, their by-catches are limited to 10% of the catches, and the number of vessels allowed to land such by-catches should remain stable, as compared to the last 18 months.

Those fisheries subject to the prohibition but not benefitting from a derogation will have to discard any catches of eastern Baltic cod.

On what grounds is the Commission allowed to adopt such drastic measures?
Quali sono i motivi per cui la Commissione adotta misure così drastiche?

The Regulation on the Common Fisheries Policy 1380/2013 provides in its article 12 that, in case of evidence of a serious threat to the conservation of a stock, and on imperative grounds of urgency, the Commission can adopt emergency measures to alleviate the threat.
L’articolo 12 del regolamento (UE) n. 1380/2013 relativo alla politica comune della pesca prevede che, in caso di grave minaccia per la conservazione di uno stock o per motivi imperativi d’urgenza, la Commissione può adottare misure di emergenza per attenuare la minaccia.

In the same line, the Multiannual Plan for the fisheries in the Baltic Sea obliges the EU to take remedial measures when a stock’s biomass is below safe biological limits;
Seguendo lo stesso principio, il piano pluriennale per la pesca nel Mar Baltico obbliga l’UE ad adottare misure correttive qualora la biomassa dello stock sia al di sotto dei limiti biologici di sicurezza;

such remedial measures may be suspending the targeted fishery and the adoption of emergency measures by the Member States and/or the Commission.
tali misure correttive possono comportare la sospensione dell’attività di pesca mirata e l’adozione di misure di emergenza da parte degli Stati membri e/o della Commissione.

We are already in July – why did the Commission not adopt emergency measures earlier in the year?

The Commission can only act upon scientific evidence.The scientific evidence of the situation was published by the International Council for the Exploration of the Sea (ICES) on 29 May;

and the Commission has taken swift action since then.

The International council for the Exploration of the Sea (ICES) states that the impact of the emergency measures is marginal.

Hence, is it at all worth adopting emergency measures for 2019?
Vale dunque la pena ricorrere all’adozione di tali misure nel 2019?

ICES states that taking emergency measures in 2019 will lead to an estimated increase of about 4% of the stock’s biomass in 2020 compared to a scenario where no action is taken.
Secondo il CIEM, l’adozione delle misure di emergenza nel 2019 porterà a un aumento della biomassa dello stock di circa il 4 % nel 2020, rispetto a uno scenario in cui non vengano adottate misure.

In the latter case, ICES estimates that the stock’s biomass would decrease by -2% in 2020.
Il CIEM ha infatti stimato che, in assenza delle misure di emergenza, la biomassa dello stock nel 2020 subirebbe un calo del 2 %.

Moreover, ICES clearly states that “fishing at any level targets the remaining few commercial sized cod (> 35cm), thus further deteriorating the stock structure and reducing its reproductive potential”.
Il CIEM ha altresì affermato che “la pesca a qualsiasi livello è volta alla cattura dei pochi esemplari di merluzzo bianco di taglia commerciale rimanenti (> 35cm), deteriorando ulteriormente la struttura dello stock e riducendone il potenziale riproduttivo”.

Therefore, waiting is not an option and would only make the starting position in 2020 even worse.
Il mancato intervento aggraverebbe ulteriormente la situazione di partenza nel 2020.

ICES states that eastern Baltic cod mostly dies from factors other than fisheries – what’s the merit then to close the fishery?
Il CIEM ha affermato che la mortalità del merluzzo bianco del Baltico orientale è per lo più causata da fattori diversi dalla pesca: a cosa serve dunque bloccare l’attività di pesca?

ICES indeed estimates that natural mortality, meaning mortality factors other than fisheries, are about three-times more important than fishing mortality.
Il CIEM ritiene effettivamente che la mortalità naturale, ossia causata da fattori diversi dalla pesca, sia tre volte superiore rispetto alla mortalità per pesca.

Hence, there is obviously a need to take a more comprehensive and long term approach to this.
Risulta quindi evidente la necessità di adottare un approccio globale e a lungo termine.

This, however, should not be taken as an excuse for not acting upon the factor we fully control and which over the decades has contributed to the current situation – fisheries.
Questo non di esime però dall’intervenire sul fattore di cui abbiamo il pieno controllo e che nel corso dei decenni ha contribuito a creare la situazione attuale, ovvero la pesca.

The cod stock needs long-term measures – what are the next steps after the expiry of the emergency measures at year-end?
Lo stock di merluzzo necessita di misure a lungo a termine – quali sono i prossimi passi da intraprendere dopo la scadenza delle misure di emergenza a fine anno?

The situation of the eastern Baltic cod stock does indeed need a long-term and comprehensive approach.
La situazione dello stock di merluzzo bianco del Baltico orientale richiede effettivamente un’impostazione a lungo termine e globale.

The legislation in place provides that emergency measures can only last for a maximum of six months, after which they may be prolonged once for another six months maximum if the conditions are still met.
Secondo la legislazione in vigore, le misure di emergenza possono avere una durata massima di 6 mesi, allo scadere dei quali possono essere prorogate per un ulteriore periodo massimo di 6 mesi qualora sussistano ancora le pertinenti condizioni.

On the fisheries side the existing Multiannual Plan from 2016 provides the necessary rules for the longer run.
Per quanto riguarda la pesca, il piano pluriennale attuale in vigore del 2016 fornisce le norme necessarie per il lungo periodo.

Indeed, as long as a stock is below safe biological limits all appropriate remedial measures have to be adopted to ensure the rapid return of the stock to safe biological levels.
Infatti, finché uno stock è al di sotto dei limiti biologici di sicurezza, è necessario adottare tutte le misure correttive opportune atte a garantire il rapido ritorno dello stock al di sopra di tali limiti.

In such a situation, the annual quotas have to be set in the lower part of the ranges provided by scientific advice, and further remedial measures have to be adopted.
In tali circostanze i contingenti annuali devono essere fissati nella parte inferiore dei valori indicati nel parere scientifico e devono essere adottate ulteriori misure correttive;

The additional measures can be further reductions of the quota, seasonal or permanent closures, modifications of the allowed gear types or fishing techniques.

How many fleets and vessels are affected by these emergency measures?
Quante flotte e navi sono interessate da queste misure di emergenza?

All Member States of the Baltic Sea participate – to different extent – in the fishery of eastern Baltic cod.
Tutti gli Stati membri del Mar Baltico partecipano, in diversa misura, alla pesca del merluzzo bianco del Baltico orientale.

Also, the emergency measures cover those areas with an important cod abundance which are in the southern part of the Baltic Sea.
Inoltre, le misure di emergenza coprono le zone con una popolazione molto abbondante di merluzzo, che si trovano nella parte meridionale del Mar Baltico.

The overall economic impact is estimated to be moderate as the overall dependency on eastern Baltic cod is low.
Si stima che tali misure avranno un impatto economico complessivo moderato, data la scarsa dipendenza complessiva dal merluzzo bianco del Baltico orientale.

There are, however, important variations from one Member State to another and from one fleet segment to another.
Vi sono tuttavia delle notevoli differenze tra i vari Stati membri e tra i segmenti di flotta.

The most affected are those, which usually target cod, lack the flexibility to redirect their fishery and are already facing structural difficulties.
Le flotte più colpite sono quelle che si dedicano principalmente alla pesca del merluzzo bianco, che non dispongono della flessibilità necessaria per riorientare le proprie attività di pesca e stanno già affrontando difficoltà strutturali.

Are there ways to compensate the fishermen for their economic losses?
Vi è modo di indennizzare i pescatori delle perdite subite?

The European Maritime and Fisheries Fund (EMFF) provides for the possibility to compensate, under certain conditions and up to certain limits, economic losses due to the temporary impossibility to fish (so-called “temporary cessation”).
Il Fondo europeo per gli affari marittimi e la pesca (FEAMP) prevede la possibilità di indennizzare i pescatori, in determinate circostanze ed entro certi limiti, delle perdite economiche causate dall’impossibilità temporanea di pesca (il cosiddetto “arresto temporaneo”).

The impossibility to fish due to emergency measures adopted by a Member State or by the Commission is an eligible case for the compensation scheme.

L’impossibilità di svolgere attività di pesca a causa delle misure di emergenza adottate da uno Stato membro o dalla Commissione è considerata un caso ammissibile per il regime di indennizzo.
