La Procura di Milano ha chiesto la condanna di quattro dirigenti ‘Google’ per non aver vigilato sulla pubblicazione di un filmato nel 2006, dove alcuni compagni di classe maltrattavano, riprendendo con il cellulare, un ragazzo con la Sindrome di Down.
The Public Prosecutor’s Office of Milan has asked that four Directors of Google be convicted of negligence for having failed to prevent the posting of a video clip, filmed on a mobile phone back in 2006 and showing four classmates bullying a youngster with Down’s Syndrome.

Per tre dei quattro manager è stata chiesta la pena di reclusione di anni uno, per il quarto di mesi sei.
The prosecution has asked that three of the four managers be sentenced to a jail term of one year and the fourth to a term of six months.

Come se non bastasse, il Comune di Milano, ritenendosi parte offesa, ha chiesto 300 mila euro alla società per danni morali e materiali.
As if this were not bad enough, the Milan Municipality, appearing as the offended party, has lodged a claim against the company for a sum of 300-thousand Euro in damages for alleged pain and suffering.

>>> Rispetto le azioni della Magistratura, ma mi permetto, dapprima, di offrire la mia solidarietà ai quattro dirigenti e, poi, di dissentire sulla decisione, poiché mi appare frutto di una mancanza di conoscenza tecnica dei meccanismi che regolano il funzionamento e l’esistenza di Youtube.
While I have the greatest respect for the judiciary, I feel obliged, firstly to offer my support to the four managers concerned and secondly to say that I have to disagree with this decision because it shows a distinct lack of technical understanding of the mechanisms that regulate the existence and the operation of Youtube.

E’ chiaro che chiunque abbia pensato di fare una simile causa è stato tratto in inganno dal fatto che il legislatore non sappia cosa sia esattamente la Rete né, tanto meno Youtube, altrimenti non avrebbe emanato una legge che mette il bavaglio alla Rete.
Clearly, whoever came up with the bright idea to institute legal action such as this has been deceived by the fact that the legislators themselves actually have no idea of what the Web really is nor, for that matter, what YouTube really is, otherwise they would not have introduced a law that seeks to muzzle the Internet.

Se Youtube avesse la possibilità di monitorare le migliaia di video pubblicati dagli utenti in un solo giorno, ed in tempo reale, se imponesse regole e vincoli stringenti in fase di pubblicazione, probabilmente chiuderebbe nel giro di un giorno e, con esso, sparirebbe il più importante canale di informazione libera ed indipendente esistente nel Web.
Even if Youtube were somehow able to monitor, in real time, each one of the thousands upon thousands of video clips that are posted by its users on any given day, and if they were to impose strict rules and stringent restrictions relating to the posting of material, they would probably have to shut down their operations within a day and thus the single most important source of free and independent information on the entire Web would disappear with it.

Inoltre, sulla vicenda specifica, aggiungo che, grazie a quel video, il malcapitato ragazzo, a cui va tutta la mia solidarietà, ha smesso di ricevere angherie quotidiane e, con lui, chissà quanti altri coetanei coinvolti in atti di bullismo.
Furthermore, as far as I’m aware, no one has yet suggested that Google, the company that owns Youtube, be given a reward of 300 thousand Euro for having, in the same way, enable the police to arrest the alleged Naples killer following the posting, also on YouTube, of a video clip showing this brutal murder, which received thousands of hits in just a few hours.

Questo per il semplice motivo che lo scalpore generato dall’episodio ha acceso ulteriormente i riflettori su questa tematica mettendo con le spalle al muro i responsabili di quel vergognoso atto.
This is simply because the general ruckus caused by that video clip has once again focussed the spotlight on these issues, thus also taking to task those individuals that commit these shameful acts.

Nessuno mi risulta abbia proposto per Google, proprietario di Youtube, un premio di 300 mila euro per aver parimenti consentito l’arresto del presunto killer di Napoli, il cui filmato dell’efferata esecuzione è stato diffuso tramite questo mezzo, attraverso centinaia di migliaia di visualizzazioni in poche ore.
Furthermore, as far as I’m aware, no one has yet suggested that Google, the company that owns Youtube, be given a reward of 300-thousand Euro for having, in the same way, enabled the police to arrest the alleged Naples killer following the posting, also on YouTube, of a video clip showing this brutal murder, which received thousands of hits in just a few hours.

Ritengo, pertanto, la persecuzione dei quattro manager l’ennesimo attacco alla Rete, rea di aver introdotto una rivoluzione sociale ed epocale che l’Italia, ingabbiata nelle sue leggi a favore di un crescente divario tecnologico rispetto agli altri Paesi, non ha ancora compreso.
I believe, therefore, that the prosecution of these four managers is nothing more than the umpteenth attack on the Internet, which stands accused of having sparked off a monumental social revolution that Italy, caged up as it is by laws that favour the growing technological divide between it and the other Countries, has not yet begun to comprehend.

Chiudo annunciando che l’Italia dei Valori sta lavorando ad un disegno di legge che mira alla diffusione del Wi-Max gratuito in tutti i grandi centri abitati, a partire dalle Provincie.
I would like to close by announcing that the Italia dei Valori party is currently working on a proposed Bill aimed at the provision of free Wi-Max services in all of the larger inhabited centres, beginning with the Provinces.

Tale disegno di legge prevederà importanti sgravi fiscali e agevolazioni per tutte quelle attività imprenditoriali che, attraverso l’utilizzo di Internet, riescano a trasferire benefici tangibili nella vendita di beni e servizi ai consumatori e alla comunità.
The bill will provide for some significant tax deductions and incentives for entrepreneurial activities that are able to transfer tangible benefits from the sale of goods and services, via the Internet, to consumers and communities.

In tale disegno di legge sarà previsto l’accesso gratuito ai costi di connessione per studenti e famiglie con basse soglie di reddito.
This Bill will also provide for free Internet access, without any connection fee, for students and low-income families.

Internet non è più un accessorio per la vita di un cittadino, ma un diritto di cui è ora che lo Stato si faccia garante.
The Internet is no longer merely an accessory in the life of a citizen, but has become a right and, as such, it is high time that the Government steps in to protect it.
