Google: everyone loses out
Ieri tre manager di ‘Google’ sono stati condannati per non aver rimosso un video riguardante dei maltrattamenti inflitti ad un ragazzo affetto da sindrome di Down e pubblicato sulla piattaforma di You Tube.
Yesterday, three ‘Google’ managers were found guilty of not having removed a video relating to the mistreatment inflicted on a youngster affected with Down’s syndrome that was published on the YouTube platform.
Il 28 novembre 2009 avevo espresso loro, in occasione della richiesta di condanna da parte della Procura di Milano, la mia solidarietà (leggi l’articolo).
On 28 November, I expressed my solidarity with them on the occasion of the Milan Prosecution’s request for their conviction (read the article).
Oggi torno a farlo poiché sono stati condannati a sei mesi di reclusione con la condizionale.
Today I am returning to doing that given that they have been sentenced to 6 months in prison with the “conditional”.
La condanna penale è arrivata anche se i legali della vittima hanno ritirato la querela, mentre gli imputati sono stati assolti in ambito civile dall’accusa di diffamazione, causa intentata dal comune di Milano e dall’associazione ‘ViviDown’ che si erano costituite come parte civile.
The criminal conviction has come even though the lawyers of the victim withdrew their complaint, while the defendants have been found not guilty of the defamation accusation in the civil courts in a case brought by the city of Milan and the association ‘ViviDown’ that were the plaintiffs.

Il comune di Milano avrebbe dovuto invitare a segnalare altre situazioni di abuso.
The city of Milan should have invited the indication of other situations of abuse.
Internet è uno strumento di ascolto e comprensione di fenomeni sociali che, proprio perché da condannare, sono una realtà che va affrontata e non occultata.
Internet is a tool for listening and for understanding social phenomena that precisely because they are to be condemned, are a reality that have to be faced up to and not kept obscured.
Quale messaggio trasmette agli adolescenti l’interpretazione di questo caso?
What message does the interpretation of this case transmit to the adolescents?
E che dire, torno a ripetere, di quel sicario della camorra le cui immagini furono trasmesse in televisione e su You Tube, consentendone la cattura da parte delle Forze dell’ordine?
And I continue to repeat, what can you say about that killer of the camorra whose images were broadcast on TV and on YouTube, making it possible for the security forces to capture him?
Dovremmo aspettarci allora che le emittenti televisive e You Yube possano ricevere, nei prossimi giorni, una denuncia per violazione della privacy da parte dei familiari della vittima o di qualche passante poiché ripresi e mandati in onda nel filmato dell’esecuzione?
Do we thus have to expect that the TV broadcasters and YouTube can receive a denunciation for violation of privacy from the family of the victim or by some passer-by as they are visible and shown in the film clip of the execution?
I pm milanesi hanno giustificato la sentenza con un laconico:
The Milan Public Prosecutors have justified the verdict with a laconic:
“Con questo processo abbiamo posto un problema serio, ossia la tutela della persona umana che deve prevalere sulla logica d’impresa”.
“With this trial we have raised a serious issue, that is the protection of the human being that has to prevail over the logic of the company”.
Ritengo che questa sentenza abbia minato la tutela della persona e dei suoi diritti fraintendendo gli eventi ed evidenziando una lacunosità della disciplina in materia.
I maintain that this verdict has undermined the protection of the person and of their rights, by misunderstanding the events and thus drawing attention to an incompleteness of the discipline in the subject area.
Mi auguro che la sentenza d’Appello possa stabilire una corretta interpretazione degli avvenimenti.
I hope that the verdict at the Appeal can establish a correct interpretation of the happenings.
