Il vilipendio ai tempi di Internet
Public insult in the age of the Internet
Nell’Italia repubblicana esiste un reato che richiama l’assolutismo monarchico e la figura di Luigi XIV: il vilipendio del presidente della Repubblica.
In Republican Italy there’s a crime that is a throw back to the absolutism of monarchy and the figure of Louis XIV: “vilipendio” {public insult} to the President of the Republic.
L’articolo 278 del codice penale recita:
Article 278 of the criminal code says:
“Offese all’onore o al prestigio del Presidente della Repubblica.
Offences against the honour or the prestige of the President of the Republic.
Chiunque offenda l’onore o il prestigio del Presidente della Repubblica è punito con la reclusione da uno a cinque anni”.
Anyone who offends the the honour or the prestige of the President of the Republic is punished with imprisonment for a period of one to five years.
Il reato di vilipendio deriva dal Codice Rocco del periodo fascista.
The crime of “vilipendio” goes back to the “Codice Rocco” of fascist times.
Nel ventennio si tutelava dal delitto di lesa maestà la figura del re e di Mussolini, dal dopoguerra i presidenti della Repubblica.
In that twenty year period the people protected from the crime of “Lese-majesty” were the king and Mussolini. Since the war, it has applied to the Presidents of the Republic.

Giovannino Guareschi fu condannato a otto mesi per una vignetta in cui il presidente Luigi Einaudi sfilava, invece che tra i corazzieri, tra bottiglioni di Nebiolo della sua tenuta, impreziositi dall’etichetta “Presidente della Repubblica Italiana”.
Giovannino Guareschi was sentenced to eight months for a cartoon in which the President Luigi Einaudi was on parade, not with ceremonial guards, but with big bottles of Nebiolo from his own vineyard, embellished with the label “Presidente della Repubblica Italiana” {President of the Republic of Italy}.

Per analizzare eventuali vilipendi non sarebbero sufficienti tutti i poliziotti incaricati di scandagliare il web al lavoro per 100 anni.
To analyse possible instances of “vilipendio”, it wouldn’t be enough to have all the police officers scanning the Web if they were working for 100 years.
La Rete è troppo grande per essere conosciuta, “Too big to know”, come sostiene David Weinberger nel suo libro dallo stesso titolo.

Io credo che Il Presidente della Repubblica giunto alla fine del suo settennato potrebbe chiedere l’abolizione dell’articolo 278, o almeno la sua depenalizzazione.
I believe that the President of the Republic, now that he has arrived at the end of the his seven year term of office, could ask for the abolition of article 278, or at least ask for it to be decriminalised.
Sarebbe un bel gesto con cui farsi ricordare.
It would be a good action to be remembered for.
