Se doveste tagliare un Tribunale (un fatto insensato in un Paese che ha bisogno di velocizzare la macchina della Giustizia), da dove iniziereste?
If you had to cut out a court (a senseless action in a country that needs to speed up the machinery of justice), where would you start?
Da un comune il cui consiglio comunale è stato sciolto due volte per mafia?
In a town where the town council has twice been dissolved because of mafia involvement?
Da un tribunale situato nell’epicentro della ‘ndrangheta?
With a court located at the epicentre of the ‘ndrangheta?

La risposta non è il tribunale di Montepulciano, né quello di Sulmona e tanto meno quello di Ivrea.

Verrà chiuso infatti il tribunale di Lamezia Terme.
In fact the one to be closed down is the court in Lamezia Terme.

In una legge dell’era Berlusconi, la 148/2011, che ha convertito la cosidetta “Manovra di Ferragosto”, il Governo ha delegato sé stesso (in modo vietato dalla Costituzione) attraverso un emendamento, su cui ha posto la fiducia, dal contenuto completamente diverso dal testo-base, perché venisse operata a mezzo decreto delegato la revisione delle circoscrizioni giudiziarie e la cancellazione di alcune sedi giudiziarie.
In a law of the Berlusconi era (law number 148/2011), that converted the so-called “Manovra di Ferragosto” (mid August Manoeuvre}, the Government delegated itself (in a way that is forbidden by the constitution), by using an amendment, on which it imposed a vote of confidence, with contents that were completely different from the basic text, because it came into operation via a legislative decree, the review of the judicial geographical boundaries and the elimination of some courts.
Stabiliti i criteri con i quali operare i tagli e subentrato il Governo Monti, il Tribunale di Lamezia Terme, il cui consiglio comunale è stato sciolto due volte per mafia, finiva nella lista nera, per il motivo di non essere in una sede capoluogo di provincia (nonostante Lamezia Terme sia, per numero di abitanti, la terza città della Calabria).
Once the criteria for making cuts were established, the Monti Government came to power and the court of Lamezia Terme (whose town council has twice been dissolved because of mafia involvement) ended up on the black list, because its location is not a provincial capital (even though Lamezia Terme is according to population numbers, Calabria’s third city).
Partivano le proteste di cittadini, avvocati, magistrati, cancellieri e personale tutto, ma il 30 maggio scorso vedeva la luce una bozza di decreto in cui si confermava la cancellazione mentre si salvavano altri tribunali più piccoli e con minor carico di lavoro ma, evidentemente, più “protetti” politicamente (a dispetto del governo tecnico).
There have been protests by the citizens, by lawyers, magistrates, court administrators and all sorts of staff, but on 30 May, there’s was the sighting of a draft decree confirming the closure while other courts have been saved. These are smaller and with a lower work load, but, obviously, they are more politically “protected” (to the annoyance of the technical government).

Il provvedimento, se sarà sciaguratamente realizzato, non porterà alcun risparmio di denaro pubblico perché il Tribunale di Lamezia Terme (che da anni è ospitato in una recente ed efficiente costruzione e vanta ottime performance di lavoro) finirà accorpato ad altre sedi giudiziarie che dovranno ampliare le proprie strutture e perché i costi di trasferimento saranno assai ingenti.
This measure, if it is unfortunately put into effect, will not bring about any saving of public money because the court of Lamezia Terme (that for years has been housed in a recent and efficient building and has an excellent work performance), will end up being merged with other courts that will have to extend their own facilities and because the moving costs will be pretty big.
Quello che nessuno dice è che l’accorpamento del Tribunale di Lamezia Terme ad altra sede di tribunale (la più vicina dista 40 km) si trasformerà in una nuova tassa ad hoc per i cittadini di Lamezia Terme e dei comuni vicini che su questo tribunale gravano.
What no one is saying, is that the merging of the court of Lamezia Terme with other courts (the closest is 40 kilometres away) will be transformed into a new ad hoc tax for the citizens of Lamezia Terme and the nearby towns that use this court.
