The first electoral law written by the citizens
“La legge elettorale del Movimento 5 Stelle, costruita insieme, sul blog, è realtà.
The 5 Star MoVement’s electoral law that has been put together via the blog, is now a reality.
È un fatto storico, un fatto unico.
It’s a historical fact, a unique fact.
Abbiamo dimostrato che la democrazia diretta può essere attuata in sostituzione della democrazia rappresentativa;
We have demonstrated that direct democracy can be carried out in place of representative democracy;
non più delega in bianco ma i cittadini possono partecipare direttamente alla costruzione delle leggi.
it’s no longer a matter of giving the politician “carte blanche” but the citizens can participate directly in the construction of laws.

40.000 cittadini iscritti al blog hanno contribuito alla costruzione, passo dopo passo, di tutti gli articoli della legge elettorale.
40,000 citizens who were signed-up members of the blog have contributed one step at a time, to the construction of all the articles of the electoral law.
Questa legge elettorale dà per la prima volta ai cittadini il vero potere di decidere.
For the first time, this electoral law gives the citizens true power to make decisions.
I cittadini potranno, come avete deciso, come abbiamo deciso, scegliere i propri candidati con la preferenza.
As you have decided, as we have decided, the citizens will be able to choose their own candidates with a preference vote.
Non ci saranno più le coalizioni non ci sarà più un premio di maggioranza.
There will no longer be coalitions. There will no longer be a majority premium.
Ciò significa che gli eletti, rappresentanti della sovranità popolare in Parlamento, dipenderanno dai cittadini e non più dal capo politico.
This means that the elected representatives, representatives of the popular sovereignty in Parliament, will depend on the citizens and no longer on the chief politician.
Questo lo abbiamo ottenuto inserendo accanto alle preferenze positive le preferenze negative.
We have achieved this by providing the opportunity to give a positive preference and a negative preference.

la prima scheda, quella alla mia sinistra, è la scheda dove si voterà la forza politica.

Qui si potrà segnare la forza politica e si potrà anche cancellare – per una o due volte – dei candidati impresentabili), il cosiddetto voto negativo.
Here, you can indicate the political entity and you can cross out either once or twice, any candidates who are unpresentable.
Come vi ricorderete abbiamo, in una delle otto votazioni, scelto il panachage, cioè due schede:
As you will remember, in one of the eight voting sessions, we chose “panachage” {vote splitting}, that means we have two ballot papers:
una si vota il partito, l’altra il voto di preferenza.
one is to vote for the party, the other is used to give the preference vote.
Una volta segnata una X su una forza politica, se all’interno dei candidati ci saranno degli impresentabili, dei collusi con la mafia, della gente che ha speso troppo per la campagna elettorale e quindi si è troppo esposta e che non piace ad un elettorato consapevole ed intelligente, lo potremo cancellare.
Once you’ve placed your X for the political entity, if there are any candidates that are unpresentable, maybe because they’ve been colluding with the mafia, or people that have spent too much on their election campaign and thus have given themselves too much exposure that is not pleasing to aware and intelligent voters, we can give them a negative preference.
E sapete che cosa comporta questo?
And do you know what this means?
Che i partiti saranno obbligati ad inserire gente credibile, onesta e competente e questo perché il vostro voto negativo comporta la cancellazione di una porzione di voto.
That the parties will be obliged to put forward people that have credibility, people that are honest and competent and this is because your negative preference will lead to the elimination of a portion of the votes.
In questo caso ci sono 10 candidati, se voi cancellate uno di questi candidati significa che la forza politica votata perderà un decimo del voto e la conseguenza diretta è semplicissima:
In this example, there are 10 candidates. If you give one of them a negative preference, that means that the political entity will lose a tenth of the votes and thus the direct consequence is simple:
i partiti e le forze politiche non potranno mettere in lista cosiddetti ‘impresentabili’ altrimenti i cittadini gli faranno perdere voti.
the parties and the political entities will not be able to list any “unpresentable” people as otherwise the citizens will make them lose votes.
Il potere quindi torna in mano ai cittadini e gli eletti dovranno rispondere ai cittadini.
Thus the power will return to the citizens and the elected representatives will have to be responsive to the citizens.
L’altra conseguenza, ancora più importante, è una delle nostre battaglie ovvero sia il vincolo di mandato.
The other consequence, that is even more important, is one of our big battles, that is the constraints associated with the mandate.
Ebbene noi inseriamo il vincolo di mandato senza modificare la Costituzione.
OK. We’ll insert the constraints associated with the mandate without altering the Constitution.

Col fatto che se l’eletto non mantiene le promesse in Parlamento i cittadini non lo voteranno più e non potrà più fare politica perché non ha mantenuto le promesse.
With the fact that if the elected representative doesn’t keep their promises in Parliament, then the citizens won’t vote for them again and they will no longer be able to stay in politics because they haven’t kept their promises.
Oggi sapete tutti che con quella schifezza del ‘porcellum’ e con quel iper schifezza dell’Italicum la rielezione di un parlamentare, di un politico, dipende esclusivamente dal capo.
You all know that today with the disgusting ‘porcellum’ electoral law and with the super-disgusting Italicum electoral law, the re-election of a parliamentarian, of a politician, depends exclusively on the boss.
Noi abbiamo eliminato i premi di maggioranza, eliminato le coalizioni.
We have eliminated the majority premium, and eliminated the coalitions.
I partiti si presentano da soli.
The parties put themselves forward on their own.
I partiti piccoli sono obbligati ad unirsi altrimenti – con il sistema che abbiamo votato – saranno svantaggiati.
Small parties are obliged to unite together as otherwise – with the system that we have voted for – they will be at a disadvantage.
Quindi abbiamo ottenuto anche l’effetto e l’obiettivo della governabilità sana e, di conseguenza, gli eletti: o rispondono a quello che hanno promesso, continuano a parlare con i cittadini, continuano a spiegare le loro decisioni e portare in Parlamento le istanze e i desideri dei cittadini, oppure la politica per loro non sarà più una professione.
Thus we have even got the effect and the objective of healthy governability and, consequently, the elected representatives will either have to be answerable for what they have promised, and will continue to talk with the citizens, and they’ll continue to explain their decisions and take the requests and the wishes of the citizens to Parliament, or they will no longer be professional politicians.
Questo veramente è un momento straordinario, questo è il più grande successo del Movimento 5 Stelle.
