Juncker Commission takes oath of independence at the European Court of Justice
La Commissione Juncker presta giuramento di indipendenza dinanzi alla Corte di giustizia europea

President Jean-Claude Juncker and the Members of the College of Commissioners are taking their formal oath of office today in Luxembourg, at the Court of Justice of the EU.
Oggi, a Lussemburgo, il presidente Jean-Claude Juncker e i membri del Collegio dei Commissari prestano giuramento formale davanti alla Corte di giustizia dell’Unione europea.

With this “solemn undertaking”, the members of the Commission are pledging to respect the Treaties and the Charter of Fundamental Rights of the EU, to carry out their responsibilities in complete independence and in the general interest of the Union.
Con questo “impegno solenne”, i membri della Commissione promettono di rispettare i trattati e la Carta dei diritti fondamentali dell’Unione europea, e di esercitare le loro responsabilità in piena indipendenza e nell’interesse generale dell’Unione.

Commissioners will also promise not to seek or take instructions from any authorities, to refrain from engaging in actions incompatible with their duties and performance of their tasks, and to respect their obligations during and after their term of office.
Si impegnano inoltre a non sollecitare né accettare istruzioni da alcuna autorità, ad astenersi da ogni atto incompatibile con le loro funzioni o con l’esecuzione dei loro compiti, e a rispettare i loro obblighi per la durata delle loro funzioni e dopo la cessazione di queste.

Commission President Jean-Claude Juncker said today:

>>> “The oath we take today is a serious one – it is an oath of independence and of respect of our Charter of Fundamental Rights.
“Quello che prestiamo oggi è un giuramento serio: un giuramento di indipendenza e di rispetto per la nostra Carta dei diritti fondamentali.

This is a strong political commitment from the whole College to ensure that the Charter is respected and complied with in all EU policies for which the Commission is responsible.
Il nostro gesto ha un importante valore politico: l’intero Collegio si impegna a rispettare e applicare la Carta in tutte le politiche dell’UE di cui la Commissione è responsabile.

This is no trifle matter – we are nothing if not for our values.”
Non è una pura formalità: noi non contiamo niente senza i nostri valori”.

Since the entry into force of the Lisbon Treaty, Commissioners also pledge to respect the EU Charter of Fundamental Rights as part of the oath of office.
Dall’entrata in vigore del trattato di Lisbona, i commissari si impegnano anche a rispettare la Carta dei diritti fondamentali.

First Vice-President Frans Timmermans explained:

“The Commission is sworn to serve the European interest, that is to make a difference for citizens.

That is why we will focus on the big priorities – growth, jobs and investment.
Per questo motivo intendiamo concentrarci sulle principali priorità: la crescita, il lavoro e gli investimenti.

And by checking that every one of our proposals matches up to the standards of the Charter, we will carry forward the real fundamental rights culture which has developed in the EU, not to replace but to complement national systems of fundamental rights.”
E verificando che ognuna delle nostre proposte sia conforme alla Carta, svilupperemo l’autentica cultura dei diritti fondamentali che ha preso forma nell’Unione, non per sostituire i sistemi nazionali di diritti fondamentali ma per completarli”.

Contesto:

The requirement for European Commission members to ‘give a solemn undertaking’ when entering into office is a long standing tradition which can today be found in Article 245 of the Treaty on the Functioning of the European Union.
L’obbligo per i membri della Commissione europea di assumere un “impegno solenne” al loro insediamento è un’antica tradizione, oggi sancita dall’articolo 245 del trattato sul funzionamento dell’Unione europea.

This provision was included for the first time in the Treaty establishing the European Economic Community (1957) and has been applied for every single Commission that took office from that date onwards.
Questa disposizione è stata inserita per la prima volta nel trattato che istituisce la Comunità economica europea (1957) e da allora viene applicata da ogni Commissione quando assume le sue funzioni.

With every new Treaty, the wording of the solemn undertaking was slightly adapted to the new legal situation.
In ciascuno dei nuovi trattati, la formulazione dell’impegno solenne è stata lievemente adattata alla nuova situazione giuridica.

Since the entry into force of the Treaty of Lisbon (2009), the text also includes a reference to the EU Charter of Fundamental Rights.
Dall’entrata in vigore del trattato di Lisbona (2009), il testo comprende anche un riferimento alla Carta dei diritti fondamentali dell’UE.

The responsibilities and duties of Commission members are laid down in Art.17 of the Treaty on European Union and Art. 245 of the Treaty on the Functioning of the European Union.
Le responsabilità e i compiti dei membri della Commissione sono indicati all’articolo 17 del trattato sull’Unione europea e all’articolo 245 del trattato sul funzionamento dell’Unione europea.

Traditionally, this solemn undertaking is made before the European Court of Justice in Luxembourg in the first months after the start of the mandate of a new European Commission.
Per tradizione questo impegno solenne viene assunto dinanzi alla Corte di giustizia a Lussemburgo nel corso del primo mese dopo l’inizio del mandato della nuova Commissione europea.

The swearing of the oath will take place between 15:30 and 17:30 CET and will be broadcast live on Europe by Satellite.
Il giuramento sarà prestato tra le 15:30 e le 17:30 CET e sarà trasmesso in diretta su Europe by Satellite.
