Test di integrità per scoprire i corrotti
Integrity test to unmask the corrupt

Morra: Allora giudice, nel ’92 inizia mani pulite.
Morra: So Judge, 1992 saw the start of the clean hands inquiry.

Da allora voi come magistrati avete fatto un lavoro notevolissimo e pur tuttavia ancora non si è riusciti a estirpare la corruzione, soprattutto nei pubblici uffici.
Since then you judges have done a sterling job and yet you have been unable to eradicate corruption, above all in the public services.

Qual è a sua avviso la causa di tutto ciò?
What is the reason for all of this in your opinion?

E come si può intervenire per sradicare del tutto?
And what can be done to eradicate it completely?

>>> Davigo: La ragione principale è che l’attività della politica degli ultimi anni non è stata quella di rendere più difficile commettere reati di corruzione, ma è stata quella di rendere più difficili le indagini sulla corruzione;
Davigo: The main reason is what the politicians have been doing in recent years namely, instead of making it harder to get away with corruption, they have been making it more difficult to investigate corruption.

sono state cambiate le norme (a favore degli autori dei reati!);
The rules have been changed (to favour those that commit the crime!);

sono state azzerate le prove acquisite e sono stati introdotti vari ostacoli.
the evidence gathered has been zeroed and various obstacles have been introduced.

E’ evidente quindi che se si rende più difficile la repressione della corruzione, è ovvio che aumentino i casi di corruzione stessa e diminuiscano le condanne, che è esattamente quello che è accaduto in Italia.
Clearly therefore, if you make it harder to suppress corruption, obviously the number of cases of corruption will increase and the number of convictions will decline and that is precisely what has happened here in Italy.

Oggi la situazione rischia di essere fuori controllo:
These days the situation is at risk of getting out of control:

il numero dei fatti, la loro gravità, l’alto numeri di persone coinvolte in questi fatti, richiede strumenti straordinari.
the number of cases, the seriousness of the cases and the high number of people involved in these cases requires exceptional tools with which to combat the crime.

Io sono convinto che la soluzione o una delle soluzioni, potrebbe essere quella di introdurre quello che gli anglosassoni definiscono il “test di integrità”, cioè le operazioni sotto copertura in questa materia.
I am convinced that the solution, or rather one of the solutions, may be to introduce what the Anglo-Saxons call an “integrity test”, in other words, sting operations against corruption.

Negli Stati Uniti io mi sono sentito fare questa osservazione:
In the United States I was asked this question:

“Ma voi in Italia fate le indagini sulla corruzione?” E alla mia risposta affermativa mi hanno detto:
“But do you guys in Italy investigate corruption at all?”In answer to my affirmative response they said:

“Ma no, ma è troppo difficile.” E allora io sorpreso, chiesi:
“No way, that’s too difficult.”Surprised, I asked them:

“Ma perchè voi non intervenite?
“But why, don’t you guys intervene?

Li lasciate rubare?
Do you just simply let them steal?”

e loro, di tutta risposta:
All they said in response was:

“No, noi facciamo il test di integrità.
“No, we do an integrity test.

Significa che subito dopo le elezioni mandiamo la polizia sotto copertura a offrire denaro agli eletti e quelli che li prendono vengono arrestati.
What it means is that immediately after the elections we send out undercover cops who offer money to those elected and those that accept the money get arrested.

Per cui a ogni elezione ripuliamo la classe politica”.
So, every time there is an election we clean out the political class.

E’ una soluzione che potrebbe essere ancorata magari a elementi indiziali già forti, come per esempio la sperequazione fra i redditi e i tenori di vita, per essere sicuri di andare a individuare persone che già sono sospettabili.
This is a solution that could be based on strong existing evidence, such as a disproportionately high lifestyle when compared to income, so as to be sure that we identify people that are already acting suspiciously.

Morra: Quindi test di integrità e massima trasparenza possibile.
Morra: In other words, integrity tests and maximum possible transparency.

L’idea di un politometro poteva anche essere efficace.
The idea of a politician-meter may even work.

Io sono convinto per esempio che tutti gli ufficiali pubblici debbano dar conto di quello che guadagnano e consumano.
For example, I am convinced that all public officials must be required to account for what they earn and what they spend.

Giudice però con gli scandali degli anni 90 che hanno funestato la partitocrazia dell’epoca ci fu una reazione popolare molto feroce, indignata.
However, Judge, with the scandals of the 1990s that ravaged the party politicians of that time, there was a very fierce and indignant public reaction.

Io ricordo molto bene che tantissimi italiani seguivano giornalmente i collegamenti con la procura di Milano perchè volevano aver notizia.
I remember very well that at that time many Italians followed all the links with the Milan Public Prosecution on a daily basis because they wanted to know what was happening.

Adesso invece sembra che MOSE, EXPO, MafiaCapitale, siano seguiti quasi con distrazione perchè quasi ci si è fatti l’idea che queste patologie siano inestirpabili dal costume italico.
These days, instead, it seems that the MOSE, EXPO and MafiaCapitale cases are being followed almost half-heartedly because we have come to the conclusion that these maladies are ineradicable by Italian custom.

Le sembra corretta questa analisi?
Does this analysis sound right to you?

E’ come se ci fossimo assuefatti?
It’s almost as if we have become accustomed to it?

Davigo: Io credo che più che assuefatta l’opinione pubblica sia rassegnata, nel senso che essendo state vanificate molte volte le speranze di un miglioramento della situazione, ritenga inevitabile ciò che sta accadendo.
Davigo: I think that the public has become resigned to it rather than accustomed to it in the sense that since the hopes for an improvement in the situation have been thwarted, people feel that the things that are happening are inevitable.

Però bisogna tener presente che uno dei problemi principali che scoraggia gli investimenti dall’estero che determina il malfunzionamento della pubblica amministrazione sono il crimine organizzato e la corruzione.
However, we must also remember that one of the main problems that discourage foreign investment and results in the malfunctioning of our public service is organised crime and corruption.

Se l’Italia non affronta questi due problemi drammatici non uscirà mai dalla situazione di difficoltà in cui si trova, anche nei rapporti con gli altri paesi.
If Italy doesn’t address these two serious problems the Country will never emerge from the difficulties it is currently facing, even in terms of our relations with other countries.

Non dobbiamo mai dimenticare che al contrario di quello che si è raccontato per diverso tempo, l’Italia non è affatto un paese insicuro, però ha due forme molto gravi di criminalità:
We must never forget that, contrary to what has been said for some time, Italy is in no way an unsafe country but it has two very serious forms of criminality:

uno è il crimine organizzato, l’altra è la devianza delle classi dirigenti che in queste misure sono tipiche solo dell’Italia.
the one is organised crime and the other is the deviance of the leadership classes, the extent of which is typical of Italy alone.

Noi esportiamo criminalità organizzata in altri paesi che ce l’hanno perchè l’abbiamo portata noi.
We export organised crime to other countries that now have it because we took it there.

Così come in altri paesi per atti di gravità infinitamente minore rispetto a quelli che ogni sera apprendiamo dai notiziari televisivi, le persone vengono costrette alle dimissioni.
However, whereas in other countries individuals are forced to resign for committing offences that are far less serious than those we learn about every night on the television news.

Da noi restano al loro posto fino a quando non vengono i carabinieri a prenderli!
Here in Italy those individuals carry on in their jobs until the Carabinieri go and get them!

Le norme anticorruzione non esistono
Anti-corruption regulations don’t exist

Morra: Giudice un’ultima domanda.
Morra: Judge, one final question.

Da circa nove mesi il cosiddetto pacchetto anticorruzione giace in Senato, ogni tanto viene ripreso:
The so-called anti-corruption package has been languishing in the Senate for about the last nine months.

Ogni tanto poi viene bloccato e di fatto le aspettative relative all’approvazione di nuove norme che con vigore contrastino la corruzione vengono puntualmente deluse.
Every now and then it gets hauled out and dusted off, only to be blocked once again and, as a result, expectations regarding the approval of new regulations that will vigorously fight corruption are once again dashed.

Di cosa c’è necessità, anche, per esempio, a livello parlamentare?
What is needed, for example even at the Parliamentary level?

Come si può fare per far sì che il paese si doti di norme certe?
How can we ensure that the Country equips itself with some definite rules?

Anche perchè gli ultimi avvenimenti di natura parlamentare e ministeriale raccontano di manine che introducono norme, come dire…) “opinabili”, rimanendo sull’eufemismo…
Especially since recent parliamentary and ministerial occurrences have revealed “little hands” introducing regulations that are questionableto say the least, euphemistically speaking…

Davigo: Anche qui io credo che se ci fosse una maggiore sensibilità da parte dei parlamentari, soprattutto alle pressioni che vengono dalla comunità internazionale, la quale da molto tempo chiede all’Italia di fare pulizia della sua classe dirigente e ci chiede l’attuazione delle convenzioni internazionali che l’Italia ha sottoscritto, a cominciare da quella dell’OCSE sulla corruzione transnazionale, a quella dell’ONU sulla corruzione, da quella del Consiglio d’Europa sempre sulla corruzione, di introdurre una serie di normative che riducano il fenomeno a fisologia, dando per scontato che la situazione italiana non è affatto fisiologica.

Davigo: Here too I believe that if the parliamentarians were a little more open, above all to the pressure coming from the International community, which has for a long time been asking Italy to clean up its leadership class and is asking us to implement the International conventions that Italy has signed, starting with the OCSE convention on cross-border corruption, the UNO convention on corruption and the European Commission convention on corruption, to introducing a series of regulations that reduce this phenomenon to physiology, taking for granted that the Italian situation is not physiological at all.

Del resto negli indici di percezioni siamo agli ultimi posti in Europa.
After all, in the perception indices, we are nearly bottom of the list in Europe.

L’importanza della cultura
The importance of culture

Morra: Quindi da questo punto di vista dobbiamo sperare che l’Europa rappresenti una via d’uscita e non una causa di ulteriore aggravamento della situazione.
Morra: So, from this point of view, we must hope that Europe represents a way out for us rather than a cause of further aggravation.

Un ultimissimo quesito, di natura… cultural-morale:
One last cultural-moral question if I may:

lei che per tanti anni ha dedicato la vita all’amministrazione della giustizia, cosa pensa si possa e si debba fare in termini di investimenti culturali per far fare al nostro paese questo benedetto “salto di qualità”?
as someone that has for many years dedicated his life to the justice system, what do you think we should do in terms of cultural investment in order to finally get this country of ours make this blessed “quantum leap?

Perchè io noto che proprio in termini di percezione della corruzione e anche dell’effettività delle norme noi anche nelle piccole cose siamo ormai rassegnati a veder sempre chi evade la norma, chi viola la norma a farla franca.
I ask because I see that, precisely in terms of the perceptions about corruption and also the effectiveness of the regulations, even in the small things we have now become resigned to the fact of seeing everyone break the rules all the time and those that do break the rules, getting away with it.

C’è proprio un atteggiamento diffuso.
This is indeed an extremely widespread behaviour.

Davigo: C’è un problema molto serio che riguarda anche le istituzioni scolastiche.
Davigo: There is a very serious problem that also regards the educational institutions.

Io racconto sempre che pur essendo andato alle scuole elementari in un piccolo comune della provincia di Pavia dove sono nato, alle scuole elementari ho ricevuto una formazione culturale di tipo mafioso, perchè quando il maestro usciva di classe, lasciava al capoclasse l’incarico di segnare sulla lavagna i buoni e i cattivi.
I always tell the story that although I attended a primary school in a very small little municipal district in Pavia Province where I was born, in primary school I received a mafia-style cultural education because whenever the teacher left the class he ordered the class captain to write the names of those who were good and bad on the chalkboard.

Il capoclasse andava alla lavagna a tirare una riga, scriveva i buoni e i cattivi sottolineati, solo sulla base di rapporti clientelari:
The class captain would go up to the board, draw a line and write the names of the good classmates and the bad classmates, underlined, based entirely on a business relationship;

chi gli dava il cioccolato, chi gli dava gli pallone, cose di questo genere.
in other words who gave him something at that time, perhaps some chocolate or a balloon, things like that.

I cattivi non li segnava mai.
He never actually wrote down the names of the naughty ones.

Se qualcuno esagerava nel fare baccano, dopo averlo richiamato varie volte, cominciava a scrivere le prime lettere del cognome dei cattivi e immancabilmente dai banchi arrivava il grido “SPIA”!
If someone got too noisy, after having pulled them up several times he would begin to write the first few letters of the offenders’ surnames and, without fail, from the benches the students’ voices would shout out “SPY”!

Ora, quando si è spia?
So when does one become a spy then?

Si è spia rispetto al nemico invasore, si è spia rispetto al tiranno.
One can be a spy in the eyes of an invading enemy or in the eyes of a tyrant;

Non si è spia rispetto alla legittima autorità del proprio paese.
but you cannot be a spy in the eyes of the legitimate authorities in your own country.

Nessuno di noi aveva mai dubitato che il maestro fosse investito di legittima autorità.
None of you ever doubted that the teacher indeed had the legitimate authority;

E che anche il capoclasse, ancorchè fetente, fosse investito di legittima autorità per delega del maestro.
or even that the class captain, while he may have been a bit of a stinker, had the legitimate authority delegated to him/her by the teacher.

Ma in quel contesto il grido “spia” diventava apologia dell’omertà che è uno dei pilastri fondanti della cultura mafiosa.
However, in that context, the cry of “spy” became an apology for “omertà” (see no evil, hear no evil…), which is one of the pillars of mafia culture.

Cioè non importa che quello sia davvero cattivo, tu non lo devi scrivere.
So it really doesn’t matter that the guy is actually really bad, you must not write him up.

C’è però di più e di peggio.
But there’s more, and even worse.

Sono stato ovviamente studente anche io e ho dovuto verificare sulla base dei miei ricordi che era vero quello che diceva l’onorevole Andreatta;
I was obviously also a student and based on my memory I had to verify whether what the Honourable Andreatta was saying was indeed true;

e cioè che la scuola italiana crea pessimi studenti abituati a coalizzarsi fra di loro a danno dell’insegnante e in prospettiva saranno pessimi cittadini perchè il rapporto insegnate-studenti è metafora del rapporto Stato-cittadini.
namely that Italian schools create terrible students who are used to ganging up against the teacher and will go on to become terrible citizens because the teacher-student relationship is a metaphor for the State-citizen relationship.

Una volta negli Stati Uniti mi hanno raccontato una cosa a cui ho stentato a credere. E allora mi hanno portato in una scuola per convincermi che era vero.
When I was in the United States I was once told something that I found very difficult to believe, so they took me to a school in order to convince me that it was indeed true.

La cosa a cui non ero disposto a credere era che gli insegnanti dessero esercizi da fare a casa a tempo.
The thing that I found very difficult to believe was that the teachers gave the students timed exercises to do at home.

Per cui gli studenti andavano a casa, mettevano il contaminuti e allo scadere del tempo smettevano di fare l’esercizio che stavano facendo e tornavano a scuola il giorno dopo con il compito al punto in cui erano arrivati.
The children would go home, switch on a timer, stopped working on the exercise when the allocated time was up and returned to school the next day with the homework done as far as they had gotten when the time expired.

Ora, andai in questa scuola e la prima cosa che mi colpì fu lo stupore di insegnanti e studenti per la mia incredulità, cioè non riuscivano a capire perchè io non volessi credere a una cosa che per loro era ovvia.
Now, I went to that school and the first thing that struck me was the teachers and the pupils’ surprise at how shocked I was, in other words, they simply could not understand why I couldn’t believe something that was so obvious to them.

E poi mi hanno spiegato perchè funzionava così, dopo che io dissi a loro guardate che da noi non è così:
Then they explained why things worked as they did, after I told them that it certainly didn’t work like that here.

se a noi viene data una ricerca da fare a casa vengono mobilitati parenti e affini fino al quindicesimo grado per far fare una bella ricerca allo studente.
If we are given a project to do at home, parents and every relation, no matter how distant, are mobilised to ensure that the child puts together a good project.

E mi spiegarono che da loro nessuno copia.
Then they explained to me that no one copies work over there.

Se qualcuno non sa una cosa si alza e chiede spiegazioni all’insegnante.
If someone doesn’t know something, he/she gets up and asks the teacher to explain it to them.

Al mio stupore mi spiegarono che questo accade, intanto perchè non c’è il valore legale del titolo di studio e quindi non conta ciò che uno è ma ciò che uno sa, ma soprattutto gli esami importanti nella vita non sono come da noi quelli di uscita da un ciclo scolastico, ma quelli di entrata e di ammissione al ciclo scolastico successivo.
To my surprise they told me that this happens firstly because educational qualifications do not have the same legal value that they do here in Italy so it what you are is not as important as what you know, but above all the important tests in life are not like here by us, in other words to complete a study cycle, but instead to start the next study cycle.

Esami che gli studenti faranno davanti a persone che non hanno mai visto.
These are exams that the students will sit before people that they have never met.

In quel contesto l’insegnante è l’allenatore che li prepara alle prove vere che faranno davanti a qualcun’altro.
In that context, the teacher is like a trainer that prepares the students for real tests that they will sit before someone else.

Ingannare non ha alcun senso.
Cheating makes no sense whatsoever.

Io non so se la loro scuola sia migliore della nostra, magari no, non è questo.
Now I don’t know whether their schooling is better than ours, perhaps not, but that’s not the issue.

Ma la loro scuola insegna la lealtà. La nostra insegna la furbizia.
However, their schooling teaches them loyalty whereas ours teaches our children street smarts.

Morra: anche da questo punto di vista c’è molto da lavorare.
Morra: Here too there is still a lot to be done.
