“Una sentenza del Tribunale di Genova (272/2015 del 3/4/2015) ha dichiarato l’illegittimità del licenziamento di un dipendente di una compagnia di call center.
“A judgment of the Genoa Tribunal (272/2015 dated 3/4/2015) has declared illegitimate the sacking of an employee from a call centre company.

Il licenziamento risale al Giugno 2013 ed è avvenuto nell’ambito di un licenziamento collettivo che ha riguardato 100 operatori della sede di Genova che ha cessato la sua attività.
The sacking happened in June 2013 and it was part of an action affecting 100 operators working in the Genoa office that closed up shop.

L’azienda in questione, la Call & Call ha molte sedi in tutta italia;
The company, Call & Call has a lot of offices all over Italy.

la sede di Genova (s.a.s) si differenziava solo formalmente dalle altre (s.r.l.);
The office in Genoa was formally a separate company of the type defined by the letters (s.a.s) whereas the others were of the type defined by the letters (s.r.l.).

ma non c’era alcuna distinzione in concreto, posto che collaborava strettamente con le altre sedi nella gestione degli stessi clienti.
But there was no basic difference between the different companies and they all worked closely together and managed the same set of clients.

>>>  Mentre a Genova licenziava 100 operatori la sede di Spezia ne assumeva circa 1000.
While the company in Genoa was getting rid of 100 operators, the office in La Spezia was taking on about 1000.

Il giudice ha ritento il licenziamento illegittimo, accertando l’unicità dell’impresa tra le varie sedi della Call & Call, e giudicando invalida la procedura di licenziamento collettivo perchè l’azienda avrebbe dovuto valutare la possibilità di assumere il personale in forza alla sede di Genova presso le altre sedi prima di procedere al licenziamento.
The judge said that the sacking was not legitimate because he said that the company, Call & Call, is a single company with a number of offices and he ruled that the sacking procedure was invalid because the company should have examined the possibility of taking on the Genoa staff in other locations before going ahead with letting them go.

Cosa c’entra l’Inps?
What has INPS got to do with this?

La Call & Call Genova ha messo in cassa integrazione a zero ore dal dicembre 2010 al Giugno 2013 i cento dipendenti di Genova.
The Genoa office of Call & Call made 100 employees temporarily redundant from December 2010 to June 2013.

In totale fanno 2 anni e mezzo di CIGS.
So that means for 2 and a half years they were receiving money from the Temporary Redundancy Fund.

Dopo il licenziamento collettivo i dipendenti hanno percepito il trattamento di mobilità per circa due anni.
After they were all sacked, the employees received an unemployment allowance for about two years.

Il costo complessivo dell’operazione per l’INPS credo possa essere stimato nell’ordine dei 4/5 milioni di euro.
I believe that the overall cost of the operation for INPS could be around 4 to 5 million euro.

Nel frattempo l’azienda a livello nazionale ha moltiplicato fatturato, dipendenti e sedi, ponendo a carico dello stato 100 dipendenti genovesi per assumerne altrettanti altrove a condizioni evidentemente più convenienti per il datore di lavoro.
Meanwhile at a national level, the company has multiplied not only its turnover, but also the number of its employees and offices and it has positioned 100 employees from Genoa to be supported by the state while taking on the same number elsewhere with employment conditions that were evidently more favourable to the employer.

Lo sapevano tutti, sindacati, regione (che ha approvato la cassa in deroga), il Comune di Genova, ma nessuno ha avuto nulla da obiettare, c’è una tolleranza diffusa su questi comportamenti.
Everybody knew what was happening. This included the trade unions, the region (that approved the request for an exemption), and the city of Genoa. But no one objected. There’s widespread tolerance of this sort of behaviour.

In questi giorni risulta che la Call & Call stia licenziando nella sede di Milano per riassumere altro personale al sud con le agevolazioni del job act.
In the last few days, Call & Call has been getting rid of staff in its Milan office and taking on other staff in the south.This is facilitated by the new “jobs act”.

Anche in questo caso è lo stato che finanzia le assunzioni con il Job Act.
Once more, in this case, it is the state that is providing the money to recruit people under the Jobs Act.

L’inps non ha soldi, ma li utilizza senza preoccuparsi troppo per finanziare politiche commerciali spregiudicate;
INPS has no money, but it is using money without much bother, to finance unrestrained commercial policies.

nel silenzio e nella tolleranza, per non dire con la collaborazione, di sindacati ed amministratori.
This is going on amidst the silence of the trade unions and the administrators that are tolerating everything.

Non è un caso isolato, ma si tratta di prassi estremamente diffuse.
This is not an isolated case. It is widespread practice.

Occupandomi di diritto del lavoro, in particolare di autotrasporto, assisto frequentemente ad aziende che collocano in Cassa Integrazione gran parte del personale viaggiante assunto con contratto italiano;
As I deal with employment law specifically in the goods transport industry, I often see companies making their staff redundant.They do this to those who were taken on with Italian work contracts.

che viene sostituito di fatto da autisti polacchi e rumeni che vengono addirittura trasportati con dei pulmini in Italia.
These are then substituted with Polish or Romanian drivers who are even brought to Italy in buses.

Ci sono aziende che da anni tengono in cassa integrazione il personale viaggiante, che viene sostituito da personale assunto formalmente all’estero, che però inizia e termina le sue prestazioni in Italia.
There are companies that keep their onboard staff in a pool of redundant staff for years.These are substituted by people who are formally recruited abroad, but they start and end their period of employment in Italy.

Altre società utilizzano il personale di società controllate fittizie che svolgono in pratica mere funzioni di gestione del personale.
Other companies use the personnel of dummy affiliated companies that simply carry out staff management functions.

Gli automezzi sono di proprietà dell’azienda “madre”, la quale li noleggia senza conducente alla società controllata, che mette il suo personale alla guida dei mezzi.
The vehicles are owned by the “mother” company that hires them out without drivers to the affiliated companies that then provide their own drivers.

La società controllata dura qualche anno, poi chiude per crisi aziendale, licenzia tutti i dipendenti che entrano in mobilità;
The affiliated companies have a short life-span of a few years and then they have a financial crisis and close down. All their employees are made redundant.

la società “madre” a questo punto apre un’altra società fittizia, che assume in blocco lo stesso personale con le agevolazioni contributive.
At this point, the “mother” company opens up another dummy company that takes on all the employees who’ve been made redundant – and it gets the money made available by the state to take on redundant workers.

Ci sono autisti che hanno già cambiato formalmente tre diversi datori di lavoro, pur continuando a lavorare sui camion della medesima azienda senza soluzione di continuità.” Dario Rossi
There are drivers that have formally changed employers three times even though they are working on the same set of vehicles belonging to the same company. But they do not have continuity of service.” Dario Rossi
