Today the European Parliament has adopted the regulation, proposed by the Commission, to cut costs and formalities for citizens who need to present a public document in another EU country.
Oggi il Parlamento europeo ha adottato il regolamento proposto dalla Commissione per ridurre i costi e le formalità per i cittadini che devono presentare un documento pubblico in un altro paese dell’UE.

Currently, citizens moving to or living in another EU country must obtain a stamp to prove that their public documents (such as a birth, marriage or death certificate) are authentic.
Attualmente i cittadini che si spostano o vivono in un altro paese dell’UE devono far legalizzare i loro documenti pubblici, come i certificati di nascita, di matrimonio o di morte, per dimostrarne l’autenticità.

Under the new regulation, this stamp and the bureaucratic procedures linked to it will no longer be required when presenting public documents issued in one EU country to the authorities of another EU country.
A norma del nuovo regolamento, quando si presenteranno documenti pubblici rilasciati in uno Stato membro dell’UE alle autorità di un altro paese dell’UE, la legalizzazione non sarà più necessaria.

The regulation deals only with the authenticity of public documents, so Member States will continue to apply their national rules concerning the recognition of the content and effects of a public document issued in another Union country.
Il regolamento riguarda soltanto l’autenticità dei documenti pubblici, gli Stati membri continueranno dunque ad applicare le norme nazionali sul riconoscimento del contenuto e degli effetti dei documenti pubblici rilasciati in un altro paese dell’Unione.

“We have good news for people who move to another EU country for example to study or work,” said V?ra Jourová, Commissioner for Justice, Consumers and Gender Equality.
Vera Jourová, Commissaria per la Giustizia, i consumatori e la parità di genere, ha dichiarato: “Ci sono buone notizie per chi si sposta in un altro paese dell’UE ad esempio per studiare o lavorare.

Spesso le procedure burocratiche per presentare un documento pubblico per potersi sposare o ottenere un lavoro nel paese in cui si vive sono lunghe e costose.

Today, we put an end to this red tape and help people move easily across the European Union.”
Oggi abbiamo eliminato questi oneri burocratici per aiutare i cittadini a muoversi facilmente nell’Unione europea.”

The new regulation will put an end to a number of bureaucratic procedures:
Il nuovo regolamento eliminerà una serie di procedure burocratiche:

– public documents (for example, birth, marriage or the absence of a criminal record) issued in a Union country must be accepted as authentic in another Member State without the need to carry an authenticity stamp (i.e. the apostille);
– i documenti pubblici (ad esempio i certificati di nascita, di matrimonio o del casellario giudiziale) rilasciati in un paese dell’Unione dovranno essere accettati come autentici in un altro Stato membro senza necessità di legalizzazione (ad esempio con l’apostille);

– The regulation also abolishes the obligation for citizens to provide in all cases a certified copy and a certified translation of their public documents.
– il regolamento elimina anche l’obbligo per i cittadini di fornire in tutti i casi una copia autenticata e una traduzione asseverata dei loro documenti pubblici.

Citizens can also use a multilingual standard form, available in all EU languages, to present as translation aid attached to their public document to avoid translation requirements;
I cittadini potranno anche usare un modulo standard multilingue, disponibile in tutte le lingue dell’UE, da presentare come ausilio alla traduzione allegato al documento pubblico per evitare l’obbligo di traduzione;

– The regulation sets safeguards against fraud:
– il regolamento stabilisce tutele contro le frodi:

if a receiving authority has reasonable doubts about the authenticity of a public document, it will be able to check its authenticity with the issuing authority in the other country through the existing IT platform, the Internal Market Information System or IMI.
se l’autorità ricevente ha dubbi ragionevoli sull’autenticità di un documento pubblico, potrà verificarla con l’autorità di emissione nell’altro paese attraverso una piattaforma informatica esistente, il sistema di informazione del mercato interno o IMI.

Member States have two years and a half from the date of entry into force of the regulation to adopt all necessary measures to allow for the smooth application of the regulation at the end of this period.
Gli Stati membri hanno due anni e mezzo di tempo dalla data di entrata in vigore del regolamento per adottare tutti i provvedimenti necessari per consentirne la corretta applicazione al termine di questo periodo.

Around 13 million EU citizens live in another EU country than their own.
Circa 13 milioni di cittadini dell’UE vivono in un paese dell’Unione diverso dal proprio.

According to a Eurobarometer survey, 73% of EU citizens believe that measures should be taken to improve the circulation of public documents between EU countries.
Secondo un sondaggio di Eurobarometro, il 73% dei cittadini europei ritiene che si dovrebbero adottare misure per migliorare la circolazione dei documenti pubblici tra i paesi dell’UE.

Citizens often complain about the red tape and costs that they need to bear in order to have a public document issued in one Union country considered as authentic in another Union country.
I cittadini spesso si lamentano della burocrazia e dei costi che devono sostenere per ottenere in un paese dell’Unione un documento pubblico che sia considerato autentico in un altro paese dell’UE.

These time-consuming formalities are excessive and unnecessary and impair the enjoyment by citizens of their rights under the Treaties.
Queste formalità, che richiedono molto tempo, sono eccessive e inutili e pregiudicano il godimento da parte dei cittadini dei loro diritti sanciti nei trattati.
