The European Commission is taking Italy back to the Court of Justice of the EU for its failure to fully and completely comply with the Court’s judgment of 2012. La Commissione europea deferisce nuovamente l’Italia alla Corte di giustizia dell’UE per la mancata esecuzione della sentenza della Corte del 2012.

The Italian authorities have still to ensure that urban waste water is adequately collected and treated in 80 agglomerations across the country out of the 109 covered by the first judgment to prevent serious risks to human health and the environment.
Le autorità italiane devono ancora garantire che le acque reflue urbane vengano adeguatamente raccolte e trattate in 80 agglomerati del paese, dei 109 oggetto della prima sentenza, al fine di evitare gravi rischi per la salute umana e l’ambiente.

On 19 July 2012, the Court of Justice of the EU ruled (case C-565/10) that the Italian authorities were violating EU law (Council Directive 91/271/EEC) by not adequately collecting and treating the urban waste water discharged by 109 agglomerations (towns, cities, settlements).
Il 19 luglio 2012 la Corte di giustizia dell’UE aveva statuito (causa C-565/10) che le autorità italiane violavano il diritto dell’UE (direttiva 91/271/CEE del Consiglio) poiché non provvedevano in modo adeguato alla raccolta e al trattamento delle acque reflue urbane di 109 agglomerati (città, centri urbani, insediamenti).

Four years later, this issueremains unaddressed in 80 agglomerations, covering more than six million people.

The lack of adequate collection and treatment systems for these 80 agglomerations poses significant risks to human health, inland waters and the marine environment.
La mancanza di adeguati sistemi di raccolta e trattamento in questi 80 agglomerati pone rischi significativi per la salute umana, le acque interne e l’ambiente marino.

The Commission is calling on the Court of Justice of the EU to impose a lump sum payment of €62,699,421.40.
La Commissione ha chiesto alla Corte di giustizia dell’UE di comminare una sanzione forfettaria di 62 699 421,40 euro.

The Commission is also proposing a daily penalty payment of €346,922.40 if full compliance is not achieved by the date when the Court issues its ruling.
La Commissione propone inoltre una sanzione giornaliera pari a 346 922,40 euro qualora la piena conformità non sia raggiunta entro la data in cui la Corte emette la sentenza.

The final decision on the penalties rests with the Court of Justice of the EU.
La decisione finale in merito alle sanzioni spetta alla Corte di giustizia dell’UE.

Ensuring that all urban areas have waste water treatment facilities working properly can bring considerable benefits to EU citizens, as untreated water poses risks to human health and the environment.
Garantire che tutte le aree urbane dispongano di strutture per il trattamento delle acque reflue correttamente funzionanti può comportare considerevoli vantaggi per i cittadini dell’UE, poiché le acque non trattate pongono notevoli rischi per la salute umana e l’ambiente.

Background
Contesto

The Urban Waste Water Treatment Directive (Council Directive 91/271/EEC)requires Member States to ensure that agglomerations (towns, cities and settlements) properly collect and treat their urban waste water.
Secondo quanto previsto dalla direttiva sul trattamento delle acque reflue urbane (direttiva 91/271/CEE del Consiglio), gli Stati membri sono tenuti ad assicurarsi che gli agglomerati (città, centri urbani, insediamenti) raccolgano e trattino in modo adeguato le proprie acque reflue urbane.

Untreated waste water can be contaminated with harmful bacteria and viruses and, thus, presents a risk to public health.
Le acque reflue non trattate possono essere contaminate da batteri e virus nocivi e rappresentano pertanto un rischio per la salute pubblica.

It also contains nutrients, such as nitrogen and phosphorous, which can damage freshwaters and the marine environment by promoting the excessive growth of algae that chokes other life, a process known as ‘eutrophication’.
Contengono, tra l’altro, nutrienti, come l’azoto e il fosforo, che possono danneggiare le acque dolci e l’ambiente marino favorendo la crescita eccessiva di alghe che soffocano le altre forme di vita, processo conosciuto come eutrofizzazione.

Under the Council Directive 91/271/EEC, towns and cities with a population equivalent of more than 15,000 inhabitants, which discharge urban waste water into receiving waters, arenot considered to be sensitive areas were required to have systems for collecting and treating their waste water in place as of 31 December 2000.
Ai sensi della direttiva 91/271/CEE del Consiglio, le città e i centri urbani con un numero di abitanti equivalenti superiore a 15 000 che scaricano le acque reflue urbane in acque recipienti non considerate aree sensibili erano tenuti a dotarsi di sistemi per la raccolta e il trattamento delle acque reflue entro il 31 dicembre 2000.

It follows that Member States must ensure that urban waste waters are adequately collected and treated before they are discharged into the environment.
Ne consegue che gli Stati membri devono assicurare che le acque reflue urbane vengano opportunamente raccolte e trattate prima che siano scaricate nell’ambiente.

Under Article 260 of the Treaty on the Functioning of the European Union(TFEU) if a Member State has not taken the necessary measures to comply with a judgment of the Court of Justice, the Commission may refer the matter to the Court of Justice.
A norma dell’articolo 260 del trattato sul funzionamento dell’Unione europea (TFUE), se uno Stato membro non ha adottato le misure necessarie per conformarsi ad una sentenza della Corte di giustizia, la Commissione può adire la Corte di giustizia.

The decision on a second referral to the Court of Justice on the basis of Art. 260 of TFEU must always be accompanied by a proposal for a penalty and/or lump sum payment.
La decisione relativa a un secondo deferimento alla Corte di giustizia sulla base dell’articolo 260 del TFUE deve sempre essere corredata di una proposta di sanzione e/o somma forfettaria.

Calculation of the penalty payment is based on a method that takes account of the seriousness of the infringement, having regard to the importance of the rules breached and the impact of the infringement on general and particular interests, its duration and the size of the Member State, with a view to ensuring that the penalty itself has a deterrent effect.
Il calcolo della sanzione da versare prende in considerazione la gravità dell’infrazione, tenuto conto dell’importanza delle norme violate e degli effetti di tale violazione sugli interessi generali e particolari, della sua durata e della grandezza dello Stato membro, al fine di garantirne l’effetto dissuasivo.

Rulings by the Court are binding on all EU Member States as well as on the EU institutions themselves.
Le sentenze della Corte sono vincolanti per tutti gli Stati membri dell’UE, nonché per le stesse istituzioni dell’UE.

Therefore, the second referral to the Court is necessary to ensure compliance in these 80 remaining agglomerations, given the very slow progress and the repeated failure to meet the pre-announced deadlines.
Pertanto, il secondo deferimento alla Corte è necessario per garantire l’osservanza delle disposizioni in questi 80 agglomerati restanti, vista l’estrema lentezza dei progressi compiuti e la ripetuta inosservanza dei termini preventivamente annunciati.

Other Member States (Belgium, Greece, Luxembourg and Portugal) have already been subject to penalties in similar cases and Spain was referred to Court for a second time and might also face fines.
Altri Stati membri (Belgio, Grecia, Lussemburgo e Portogallo) sono già stati oggetto di sanzioni pecuniarie in casi analoghi, mentre la Spagna è stata nuovamente deferita alla Corte di Giustizia e potrebbe subire sanzioni.
