Australian Federal Police say Wikileaks committed no crime

The Australian Federal Police (AFP) has stated that the whistle-blowing website known as WikiLeaks, has committed no crimes in Australia by publishing over 250,000 United States diplomatic cables.
La polizia federale australiana (AFP) ha dichiarato che il sito web fornitore di rivelazioni noto come WikiLeaks, non ha commesso alcun crimine in Australia con la pubblicazione di oltre 250.000 cablogrammi provenienti da fonti diplomatiche statunitensi.

An investigation by the AFP into the release of the cables revealed that Wikileaks had not broken any laws under Australian jurisdiction.
Un’indagine condotta dall’AFP relativamente alla divulgazione dei cablogrammi ha reso noto che Wikileaks non ha violato alcuna legge sotto la giurisdizione australiana.

“[The AFP has] not identified any criminal offences where Australia has jurisdiction and as a result have not commenced an investigation,” said Robert McClelland, attorney-general of Australia in a statement to the press.
“[L’AFP] non ha individuato alcun reato penale nell’ambito della giurisdizione australiana e di conseguenza non ha aperto alcun inchiesta”, ha precisato Robert McClelland, procuratore – generale australiano, in una dichiarazione concessa alla stampa.

“As has previously been stated, given the documents published to date are classified by the United States, the primary jurisdiction for any investigation into the matter remains the United States.”

Le attività investigative sull’operato di Wikileaks sono intervenute dopo che il governo australiano ha rimesso la propagazione dei dispacci diplomatici statunitensi all’AFP.

McClelland stated that the Government’s reaction to the WikiLeaks issue was “prudent.”
McClelland ha asserito che la reazione del governo alla pubblicazione ad opera di Wikinews è stata “prudente”.

Further cables that the Government queries the legality of would also be forwarded to the AFP as well.

He also added that the government remains “concerned” about the situation and “unauthorised and irresponsible distribution of classified material.”
Ha anche aggiunto che il governo rimane “preoccupato” sia per la situazione che per “la distribuzione non autorizzata ed irresponsabile di materiale riservato”.

Controversy had also been raised today after Julia Gillard changed her stance on the release of the cables from calling the action “illegal,” to calling it “grossly irresponsible,” after the AFP had released their findings.
Quest’oggi si sono scatenate delle polemiche dopo che Julia Gillard ha cambiato la sua posizione, in merito alla diffusione dei cablogrammi, passando dal definire tale linea di condotta “illegale” al qualificare la medesima ” estremamente irresponsabile”, dopo che l’AFP ha rilasciato le proprie conclusioni.

Ms Gillard said at a press-conference in Sydney today that she did not intend to say that the release of the cables was illegal, but that but that their theft was.
In giornata la signora Gillard ha riferito in una conferenza stampa a Sidney che non intendeva affermare  tanto che la messa in circolazione dei cablogrammi fosse illegale, quanto invece che lo fosse il loro furto.

Deputy leader of the opposition (Liberal Party), Julie Bishop, said there was no room for Ms Gillard to “weasel out of it.”
Il vice-leader dell’opposizione (partito liberale) Julie Bishop, ha precisato che non ci fosse spazio per la signora Gillard per “eludere le responsabilità”.

“She is a lawyer. She well knows about the presumption of innocence,” said Bishop.
“Lei è un avvocato.Conosce bene la presunzione d’innocenza,” ha sottolineato Bishop.

She added that the prime minister’s legal background did not warrant her comments.
Ha aggiunto che il background legale del primo ministro  non giustificasse i suoi commenti.

Calls have also been voiced by the Green’s Senator, Scott Ludlam, for Ms Gillard to retract her comments.
Peraltro più appelli perchè la signora Gillard ritrattasse i suoi giudizi sono stati lanciati dal senatore dei Verdi, Scott Ludlam.

Wikileaks has been the subject of past investigations in Australia.

In March of 2009, the proposed Australian Communications and Media Authority internet blacklist was leaked to the website.

That matter was also referred to the AFP, who later abandoned pursuing criminal charges.
