European banking supervision taking shape, say EU Auditors
Secondo gli auditor della Corte, la vigilanza bancaria europea sta prendendo forma

A report published today by the European Court of Auditors reveals that the Commission’s reform of banking sector legislation and the creation of the European Banking Authority were important first steps in response to the financial crisis.
In una relazione pubblicata oggi, la Corte dei conti europea rivela che la riforma della Commissione riguardante la normativa del settore bancario e la creazione dell’Autorità bancaria europea (ABE) ha rappresentato un primo passo importante per rispondere alla crisi finanziaria.

The European Banking Authority has provided the elements of a new regulatory and supervisory system for the banking sector, taking into account its resources and limited legal powers.
L’ABE ha fornito gli elementi di un nuovo sistema di regolamentazione e di vigilanza del settore bancario, pur considerando le risorse di cui disponeva e dei suoi limitati poteri giuridici.

However, shortcomings were identified in cross-border banking supervision, the assessment of the resilience of EU banks, and the promotion of consumer protection.
Sono state tuttavia individuate carenze nella vigilanza bancaria transfrontaliera, nella valutazione della resilienza delle banche dell’UE e nella promozione della protezione dei consumatori.

“The financial crisis sent shockwaves throughout the EU’s banking sector, resulting in the economic and sovereign debt crisis, and the EU acted to stabilise it”, stated Mr Milan Martin Cvikl, the ECA Member responsible for the report .
“La crisi finanziaria ha scosso tutto il settore bancario dell’UE, determinando la crisi economica e la crisi del debito sovrano, e l’UE è intervenuta per stabilizzarlo”, ha dichiarato Milan Martin Cvikl, Membro della Corte responsabile della relazione.

“However, the European Banking Authority lacks the authority to make or enforce decisions on supervisory convergence and had a limited legal mandate and staff to conduct the 2011 stress tests.
“L’Autorità bancaria europea non dispone però dell’autorità di formulare o applicare decisioni sulla convergenza della vigilanza e aveva un mandato giuridico limitato e personale non sufficiente per effettuare le prove di stress del 2011.

>>> Now, with the agreement on the single supervisory mechanism and other elements of the banking union further important activities are underway.”
Attualmente, grazie all’adozione dell’accordo sul meccanismo di vigilanza unico e su altri elementi dell’unione bancaria, altre attività importanti si stanno realizzando”.

In response to the financial and economic crisis, emergency action was taken in a bid to restore confidence in financial institutions, followed later by regulatory and supervisory reforms.
In risposta alla crisi economica e finanziaria, la Commissione ha adottato misure d’emergenza atte a ripristinare fiducia nelle istituzioni finanziarie, seguite poi da riforme del quadro normativo e della vigilanza delle banche.

The Court reviewed this focussing on the period 2011 to early 2013.
La Corte ha preso in esame il periodo che va dal 2011 agli inizi del 2013.

It found that the Commission and the European Banking Authority reacted to the financial crisis with a broad regulatory agenda.
La Commissione e l’ABE hanno reagito alla crisi finanziaria con un ampio programma di regolamentazione.

However there was limited time for stakeholder consultation and there was no cross-sectoral impact assessment.
Tuttavia, dato il poco tempo a disposizione, la consultazione pubblica è stata di breve durata e non è stata effettuata una valutazione d’impatto globale.

The European Banking Authority contributed to improving the cross-border supervision of banks as a facilitator and coordinator of the work of national supervisory authorities.
L’ABE ha contribuito a migliorare la vigilanza transfrontaliera delle banche come facilitatore e coordinatore delle attività delle autorità nazionali di vigilanza.

However the day-to-day supervision of banks was carried out by national supervisory authorities, and the European Banking Authority did not have direct access to financial institutions.
Tuttavia, la vigilanza corrente delle banche è stata eseguita dalle autorità nazionali, e l’ABE non disponeva dell’accesso diretto alle istituzioni finanziarie.

Supervisory convergence through the colleges of supervisors was limited, and colleges spent too much time discussing procedures rather than focusing on risks.

The European Banking Authority lacks the authority to make or enforce decisions on supervisory convergence and to resolve disputes between NSAs.
L’ABE non dispone dell’autorità di formulare o applicare decisioni sulla convergenza della vigilanza e di risolvere le controversie tra le ANV.

The European Banking Authority had a limited legal mandate and staff to conduct the 2011 stress tests which were conducted without financial ‘back stop’ measures at EU level.
L’ABE disponeva di un mandato giuridico limitato e di personale non sufficiente per effettuare le prove di stress del 2011, che sono state condotte senza misure di sostegno finanziario di ultima istanza a livello UE.

Although stress tests were helpful in initiating the recapitalisation of a large number of banks, they revealed the limitations of such exercises when not combined with an assessment of the quality of the asset portfolio.
Anche se le prove di stress sono state utili per avviare la ricapitalizzazione di numerose banche, hanno altresì rivelato i limiti di tali esercizi quando non vengono svolti congiuntamente a una valutazione della qualità del portafoglio delle attività.

The EU auditors put forward a set of recommendations aimed to increase the effectiveness of the colleges of supervisors, reliability of bank stress tests and to ensure a successful banking union and effective banking supervision.
Gli auditor della Corte presentano una serie di raccomandazioni allo scopo di promuovere l’efficacia dei collegi delle autorità di vigilanza, l’affidabilità delle prove di stress e a garantire per un’unione bancaria e una vigilanza bancaria efficaci.

This special report (No 5/2014) entitled “European banking supervision taking shape – EBA and its changing context” assessed whether the Commission and the European Banking Authority (EBA) had satisfactorily carried out their responsibilities in setting up the new arrangements for the regulation and supervision system of the banking sector and to examine how successfully those new arrangements were functioning.

– The ECA found that the Commission and EBA reacted to the financial crisis with a broad regulatory agenda.

The Commission has in general been timely when drafting banking sector legislation.
La Commissione è stata, in generale, tempestiva nel redigere la normativa sul settore bancario.

However, the strict deadlines stemming from global agreements in G20 and the Basel Committee, and the delays in political negotiations, have reduced the time available for external stakeholders to provide input through public consultation.
Tuttavia, le scadenze ravvicinate stabilite da accordi a livello mondiale nell’ambito del G20 e del Comitato di Basilea, nonché i ritardi nei negoziati politici, hanno ridotto il tempo a disposizione delle parti interessate esterne per esprimersi nell’ambito della consultazione pubblica.

Furthermore, it has resulted in short deadlines for EBA to draft technical standards and EBA has not been able to comment on the mandates and timeliness in the legislative process in a systematic fashion.

However, its role in banking supervision tasks has been limited in many areas.

The day-to-day supervision of banks remains in the remit of the NSAs, and EBA does not carry out direct supervision of financial institutions.

EBA had the role of facilitating and coordinating the 2011 stress test, but it had neither the staff nor the necessary mandate to ensure the reliability of the stress test exercise.

In addition, the stress test was conducted without financial ‘back stop’ measures at EU level.

This Single Supervisory Mechanism (SSM) will involve cooperation between the ECB and the NSAs, where the ECB will be responsible for the overall functioning of the SSM.
Questo meccanismo di vigilanza unico (SSM) comporterà la cooperazione tra la BCE e le ANV, in cui la BCE sarà responsabile del funzionamento generale dell’SSM.

In its regulatory role, EBA has a mandate to develop technical standards and could usefully use its expert knowledge to continue in this task.
Nel suo ruolo normativo, l’ABE è incaricata di sviluppare norme tecniche e potrebbe avvalersi utilmente delle conoscenze e competenze per continuare ad assolvere tale compito.

However, questions arise over its future role in the supervision of banks, as its role is limited to coordinating and facilitating NSAs work and it lacks the power to impose specific decisions on NSAs.
In materia di vigilanza bancaria, invece, il suo futuro ruolo è incerto, in quanto l’ABE si limita a coordinare e facilitare il lavoro delle ANV e manca del potere di imporre decisioni specifiche alle ANV.

As a consequence, there is a risk of uncertainty over roles and responsibilities and of overlap between EBA and the ECB.
Vi è quindi un rischio di incertezza circa ruoli e responsabilità, nonché di sovrapposizione tra l’ABE e la BCE.

Among the set of recommendations, the ECA considers that successful EU-wide banking supervision requires a clear division of roles and accountability between EBA, the ECB and the NSAs, both those in and those outside the SSM.
Tra le varie raccomandazioni, la Corte ritiene che una buona vigilanza bancaria a livello dell’UE richieda una chiara divisione dei ruoli e delle responsabilità tra l’ABE, la BCE e le ANV, aderenti o meno all’SSM.

To avoid the risk of overlapping tasks and unclear responsibilities in some areas between the ECB, NSAs and EBA, the EU auditors recommend that roles and responsibilities be further clarified in legislation or memoranda of understanding.
Per evitare il rischio di sovrapposizione di compiti e responsabilità poco chiare in alcuni settori tra la BCE, le ANV e l’ABE, gli auditor della Corte raccomandano che i ruoli e le responsabilità vengano ulteriormente chiariti nell’ambito di atti normativi o di protocolli d’intesa.

The ECA also recommends that procedures be set up to ensure close and frequent cooperation and information exchange between the different bodies and that particular attention should be paid to the period of transition before the SSM is fully established.
La Corte raccomanda inoltre che siano poste in essere procedure per garantire una stretta e frequente cooperazione e lo scambio di informazioni tra i diversi organismi, e che particolare attenzione sia prestata al periodo di transizione prima della completa istituzione dell’SSM.
