Today’s consumers, whether shopping on-line or in a supermarket, increasingly want clearer and more understandable food labelling to help them make informed choices on the food they eat.
Indipendentemente dal fatto che acquistino online o al supermercato, i consumatori odierni esigono che l’etichettatura degli alimenti sia sempre più chiara e comprensibile così da poter compiere scelte consapevoli.

In addition, more and more people suffer from allergies.

New rules to address these sorts of issues and others will apply from 13 December 2014 across the EU.
Nuove norme per affrontare questi e altri tipi di problemi entreranno in vigore in tutta l’Unione europea a partire dal 13 dicembre 2014.

The current legislation on general food labelling dates back to 1978 and nutrition labelling rules were adopted in 1990.

Consumer demands and marketing practices have evolved significantly since then.

EU consumers want to be better informed when purchasing food.

They want labels that are understandable, accurate and not misleading.

After more than three years in the making, the new legislation will help consumers make informed decisions on the food they buy. It could aslo contribute to a better lifestyle and healthier choices.
Dopo più di tre anni di preparazione la nuova legislazione li aiuterà a prendere decisioni consapevoli in merito agli alimenti che acquistano e potrà contribuire a stili di vita migliori e a scelte più sane.

What changes can I expect to see from the new labelling scheme?
Quali cambiamenti aspettarsi dal nuovo sistema di etichettatura?

The new legislation lays down general principles on food labelling.
La nuova legislazione stabilisce principi generali per l’etichettatura degli alimenti.

It also provides more specific requirements that include for example:
Essa prevede inoltre prescrizioni più specifiche che comprendono, ad esempio:

– Improved legibility of information (minimum font size for mandatory information);
– migliore leggibilità delle informazioni (dimensione minima dei caratteri per le informazioni obbligatorie);

– Clearer and harmonised presentation of allergens for prepacked foods (emphasis by font, style or background colour) in the list of ingredients;
– presentazione più chiara e armonica (tipo e stile del carattere o colore di sfondo) degli allergeni nell’elenco degli ingredienti per gli alimenti preconfezionati;

– Mandatory allergen information for non-prepacked food, including restaurants and cafes;
– obbligatorietà delle informazioni sugli allergeni per gli alimenti non preconfezionati, compresi quelli di ristoranti e bar;

– Requirement of certain nutrition information for majority of prepacked processed foods;

Will small, illegible information be addressed?

This is a key issue addressed in the new legislation. The rules require that mandatory information must be printed in a minimum font size and voluntary information (e.g. slogans or claims) must not be presented in a way that adversely affects the presentation of the mandatory information.
Si tratta di una delle questioni fondamentali affrontate dalla nuova normativa, la quale fissa la dimensione minima dei caratteri per le informazioni obbligatorie e stabilisce che le informazioni volontarie (ad esempio slogan pubblicitari o affermazioni) non intralcino la presentazione delle informazioni obbligatorie.

Additional rules on legibility will also be established in the future.
Ulteriori regole in tema della leggibilità saranno stabilite in futuro.

Will the new rules help me to eat more healthily?
Le nuove regole aiuteranno a mangiare più sano?

In principle, yes.

Clearer information on certain important nutritional characteristics of processed foods – energy, fat, saturated fat, carbohydrate, sugars, protein and salt – will be provided.
Verranno fornite informazioni più chiare su alcune importanti caratteristiche nutrizionali degli alimenti trasformati – valore energetico, grassi, acidi grassi saturi, carboidrati, zuccheri, proteine e sale.

This will enable consumers to compare foods before purchasing, helping them to make more informed dietary choices to meet their individual requirements.
I consumatori potranno così confrontare i diversi prodotti alimentari prima dell’acquisto e compiere scelte dietetiche più consapevoli per soddisfare esigenze specifiche.

It will also be possible for information on selected nutrients to be included on the front of the package, which will make it easier for consumers to compare products when shopping.
Le informazioni relative a determinati elementi nutritivi potranno essere riportate sulla parte anteriore della confezione, rendendo più semplice per il consumatore confrontare i prodotti.

How are the information needs of people suffering from allergies taken into account?
In che modo si tiene conto delle esigenze di informazione delle persone allergiche?

The new rules strengthen the existing information on certain substances causing allergic reactions or intolerances.
Le nuove norme rafforzeranno le informazioni esistenti su alcune sostanze che provocano allergie o intolleranze.

The aim is to inform and better protect the health of people with food allergies.
L’obiettivo è quello di informare e proteggere meglio la salute di chi soffre di allergie alimentari.

Food businesses will need to provide such information on all foods.
Gli operatori del settore alimentare sono tenuti a fornire tali informazioni per tutti gli alimenti;

It is down to the national authorities in EU Member States to decide the means by which such information should be provided.

What are the food information requirements if I buy food online or through distance-selling?
Quali sono le prescrizioni in materia di informazione alimentare nel caso degli acquisti online o mediante vendita a distanza?

The new rules explicitly state that when food is sold via distance communication, most of the mandatory information on the label shall be available before the purchase is concluded.
Le nuove norme stabiliscono esplicitamente che, qualora il prodotto alimentare sia venduto a distanza, la maggior parte delle informazioni obbligatorie sull’etichetta debba essere fornita prima dell’acquisto.

This information shall appear on the material supporting the distance selling (webpage or catalogue) or through other appropriate means.
Queste informazioni dovranno figurare sul supporto della vendita a distanza (pagina web o catalogo) o essere fornite mediante altri strumenti appropriati.

This requirement takes full account of all ways of supplying food to consumers.
Questa prescrizione tiene pienamente conto di tutte le modalità di fornitura di prodotti alimentari ai consumatori.

In other words, information that is to be provided on food labels, is the same regardless of whether the product was bought online, through distance-selling means (for example a catalogue) or in a supermarket.
In altri termini, le etichette degli alimenti devono riportare le medesime informazioni a prescindere dal fatto che il prodotto sia acquistato online, a distanza (ad esempio via catalogo) o in un supermercato.

Will I be better informed on the origin of my food with the new rules?

The new rules maintain, in general, the current approach:

country of origin or place of provenance labelling on food is voluntary, unless its absence could mislead consumers.
l’indicazione del paese d’origine o del luogo di provenienza dei prodotti alimentari è volontaria, a meno che la sua assenza possa indurre in errore il consumatore.

The Regulation introduces mandatory origin labelling for fresh meat from sheep, goat, poultry and pigs.
Il regolamento introduce l’obbligo dell’etichettatura d’origine per le carni fresche di ovini, caprini, suini e pollame.

The Commission has adopted implementing rules that determine the way the origin information is expressed.
La Commissione ha adottato norme di attuazione che determinano il modo in cui possono essere riportate le informazioni sull’origine dei prodotti.

The rules, with some exemptions, provide that the Member State or third country where the animal was reared and slaughtered will appear on the label.

The country of origin or place of provenance of the main ingredients must also be listed if those ingredients originate from a different place than the finished product.

For example, butter churned in Belgium from Danish milk could be labelled as “produced in Belgium from Danish milk.”

Those rules will protect consumers from misleading origin indications and will ensure a level playing field between food business operators.
Queste regole tuteleranno i consumatori contro indicazioni d’origine fuorvianti e garantiranno parità di condizioni tra gli operatori del settore alimentare.

How can I know whether I eat an “authentic” and not a “fake” food?
Come sapere se un alimento è “autentico” o “contraffatto”?

Counterfeiting of food and drink is a major concern.
La contraffazione degli alimenti e delle bevande suscita gravi preoccupazioni.

It can take various forms, such as adulterating a product by dilution or substitution of inferior ingredients or implying a false origin of the product.
Essa può assumere forme diverse: è possibile adulterare un prodotto diluendolo o usando ingredienti di qualità inferiore, oppure suggerire una falsa origine del prodotto.

The new rules will ensure that when a food is not exactly what it appears to be, relevant information will be provided to prevent consumers from being misled by a certain presentation or appearance.
Le nuove regole faranno sì che, qualora un alimento non sia ciò che sembra, le informazioni fornite evitino che i consumatori vengano tratti in inganno dalla presentazione o dall’aspetto del prodotto.

When some ingredients, normally expected to be in the food, have been replaced by others, the substitute ingredients will be labelled prominently on the package and not only in the list of ingredients.
Se determinati ingredienti, che normalmente dovrebbero essere nell’alimento, sono stati sostituiti da altri, questi succedanei verranno indicati in modo particolarmente evidente sull’etichetta e non solo riportati sulla lista degli ingredienti.

For meat and fish products, prominent information will be given on the presence of added water and of any added proteins of different animal origin.
Per quanto concerne le carni e i prodotti della pesca, verranno fornite informazioni ben visibili sull’aggiunta di acqua o di proteine di origine animale diversa.

In addition, such foods when they give the impression that they are made of a whole piece of meat or fish, although they consist of different pieces combined together, will be labelled as “formed meat” or “formed fish.”
Tali alimenti saranno inoltre identificati sull’etichetta quali “tagli di carne combinati” o “tagli di pesce combinati” qualora sembrino essere prodotti da un unico taglio di carne o pesce nonostante consistano di parti diverse combinate assieme.

For foods implying or indicating a false origin, the new rules set certain criteria to ensure that voluntary origin indications do not mislead consumers.
Per quanto concerne gli alimenti che indicano o suggeriscono un’origine falsa, le nuove regole stabiliscono criteri per garantire che le indicazioni d’origine volontarie non traggano in inganno i consumatori.

Operators who make origin claims are required to provide further information so that people know where the characterising ingredient of the food actually comes from, not just the last country where the food was processed.
Gli operatori che riportano indicazioni relative all’origine del prodotto devono fornire informazioni aggiuntive per consentire ai consumatori di sapere da dove provengono gli ingredienti che caratterizzano l’alimento, e non solo l’ultimo paese in cui questo è stato trasformato.

Will we see the changes on the labels from 13 December 2014?
I cambiamenti sulle etichette saranno visibili a partire dal 13 dicembre 2014?

Yes, the food industry has had a transitional period of three years to ensure that that rules will come into effect as of 13 December 2014.
Sì, l’industria alimentare ha avuto un periodo transitorio di tre anni perché le suddette norme potessero entrare in vigore il 13 dicembre 2014.

However, you may still find on the market products labelled with the old rules as the Regulation provides for exhaustion of stocks for foods placed on the market or labelled before 13 December 2014 (Attention: not exhaustion of stocks for labels).
Tuttavia sarà ancora possibile trovare sul mercato prodotti etichettati secondo le vecchie norme, dato che il regolamento prevede che si esauriscano delle scorte di prodotti alimentari commercializzati o etichettati prima del 13 dicembre 2014 (attenzione: non l’esaurimento delle scorte di etichette).

The rules on mandatory nutrition information will only apply from 13 December 2016.
Le norme sulle informazioni nutrizionali obbligatorie saranno applicate solo a partire dal 13 dicembre 2016.

When however the nutrition declaration is provided on the labels after 13 December 2014, it shall comply with the rules of the Regulation.
Se fornita in etichetta dopo il 13 dicembre 2014, la dichiarazione nutrizionale dovrà tuttavia rispettare le norme del regolamento.

What should I do if I see a label that does not respect the new rules after 13 December 2014?
Cosa fare nel caso in cui un’etichetta non rispetti le nuove norme dopo il 13 dicembre 2014?

The enforcement of EU labelling rules is entrusted to the Member States and complaints should be addresses to the national competent authorities.
L’applicazione delle norme comunitarie sull’etichettatura è affidata agli Stati membri e i reclami vanno indirizzati alle autorità nazionali competenti.
