Why the distinction between the Head of State and the Head of Government

L’Assemblea Costituente discusse a lungo se mantenere la figura del Capo dello Stato distinta da quella del Capo del Governo, a molti sembrava soltanto una riedizione inutile della figura del Re.
The Constituent Assembly spent a long time discussing the issue of whether or not to keep the position of Head of State separate from that of the Head of Government.To many it seemed to be merely a useless rehash of the role of the king.

Alla fine prevalse l’idea di mantenere la carica di Capo dello Stato per non concentrare troppi poteri nelle mani del Capo del Governo e il Capo dello Stato fu pensato essenzialmente come un organo neutro, un potere di arbitrato con funzioni di mediazione e garanzia.
In the end, the idea to maintain the post of Head of State won the day, so as not to concentrate too much power in the hands of the Head of Government and the role of the Head of State was essentially viewed as a neutral institution an power for arbitration with mediation and oversight functions.

Al Presidente della Repubblica sarebbe spettato fare due cose: mediare tra le forze politiche per assicurare il buon funzionamento delle istituzioni e garantire la Costituzione.

7 anni di mandato: un’esagerazione
7-year term: over the top

Quindi il primo luogo il Presidente della Repubblica avrebbe dovuto avere un’età piuttosto avanzata.
So, firstly the State President would have to be an older person.

Infatti è la carica che richiede l’età più alta, 50 anni, e per i motivi di cui sopra, avrebbe avuto una durata, il mandato, molto lunga, 7 anni.
Indeed the post requires that the incumbent be older than 50 years of age and, for the aforementioned reasons, his term in office would be 7 years, which is actually pretty long.

Ad oggi sono poche le costituzioni che assegnano 7 anni al Capo dello Stato, la nostra, quella francese e qualche altra, a parte ovviamente le monarchie, in modo da ottenere un’elezione alla carica di Presidente della Repubblica, come coronamento della vita politica di un esponente e in qualche modo sottrarlo alla pressione del Parlamento e di altre forze politiche.
To date, very few other constitutions provide for a 7-year term for the Head of State, namely ours, the French constitution and a few others, obviously except in the case of monarchies, so that a person’s election to the post of State President in fact represents the crowning glory of the member’s political life and so that he is removed from any pressure exerted by Parliament or by the political parties.

Quindi si immagina che il Presidente della Repubblica dopo avere svolto la sua funzione, abbia un processo di notabilizzazione, ovvero sia un notabile.

Allora al Presidente vennero dati tutta una serie di poteri, dei quali alcuni ordinari, altri invece destinati a essere usati solo in determinate circostanze, cosiddetti poteri silenti (in condizioni normali).

Al Presidente vennero attribuiti una ventina dei poteri dei quali voglio ricordare i più importanti:
The State President was assigned around twenty different powers, the most important of which I would like to remind you of here:

1. rappresentanza della Nazione,
1. the power to represent the Nation,

2. facoltà di indire elezioni e referendum,
2. the power to call an election or a referendum,

3. sciogliemento delle Camere quando queste risultino prive di una maggioranza o incapaci di svolgere le proprie funzioni.
3. the power to dissolve the Chambers when there is no clear majority or where they are unable to carry out their duties,

4. nomina del Presidente del Consiglio e dei Ministri,
4. the power to appoint the Prime Minister and Council President,

5. nomina di 5 membri della Corte Costituzionale e di 5 senatori a vita,
5. the power to appoint 5 members of the Constitutional Court and 5 Honorary Lifelong Senators,

6. firma di leggi e decreti e può rinviarli, qualora ritenga che non abbiano la copertura di spesa o rappresentino violazioni costituzionali, alla Camera per una nuova deliberazione
6. the power to sign laws and decrees or to send them back to the Chamber for re-discussion should he believe that there is inadequate financial coverage for them, or that they are in violation of the Constitution,

7. rivolge messaggi alle Camere sollecitando un certo intervento, un certa posizione, fa parte dei suoi poteri di persuasione, la cosiddetta moral suasion ,
7. the power to address the Chambers, asking that certain actions be taken or certain position be adopted, which is part of his poker of persuasion, the so-called moral-suasion,

8. concede la grazia eventualmente,
8. the power to grant potential pardons,

9. presiede il Consiglio Superiore nella Magistratura,
9. the power to chair the Upper Council of the Magistrature,

10. presiede il Consiglio Superiore della Difesa,

11. garantisce la Costituzione.

Praticamente al di sopra della legge
Essentially above the law

Il Presidente della Repubblica dura 7 anni proprio per essere in qualche modo emancipato dal Parlamento che lo ha eletto.
The State President is given a 7-year term in office precisely so that he can somehow be emancipated from the Parliament that elected him in the first place.

Il Parlamento dura 5 anni, quindi in qualche modo la carica del Presidente della Repubblica è pensata per sopravvivere al Parlamento che l’ha espresso.
The Parliamentary term lasts for 5 years, so somehow the role of State President was designed to survive the Parliament that voted the incumbent in.

Pensate che qualche volta addirittura può avere tre diversi Parlamenti, quello dell’elezione, poi uno successivo poco dopo e quello in cui finisce il suo mandato.
Just imagine, sometimes a single State President can even serve under three different Parliaments, namely the one that voted him in, a subsequent one and then a third one during whose tenure the State President’s term comes to an end.

Non può esercitare alcuni dei suoi poteri come lo scioglimento delle Camere negli ultimi 6 mesi del suo mandato, il cosiddetto “semestre bianco”.
He may not exercise certain of his powers, such as for example the power to dissolve the Chambers, within the final 6 months of his term, the so-called “white semester”.

Dunque a garanzia del Presidente ci sono una serie di misure, la prima l’abbiamo detta, la lunghezza del mandato;
So there are a number of measures to back up the State President, the first, as we said, being the length of his term in office.

il Presidente poi gode dell’irresponsabilità di fronte a qualsiasi altro organo costituzionale, per esempio il Parlamento non può votare mozioni di censura sul Presidente o richieste di dimissioni. In poche parole gode dell’immunità penale.
Then, the State President also enjoys immunity from the actions of any other constitutional body, for example, Parliament cannot vote on any motion to censure the State President or to request that he resign. In simple terms, he enjoys immunity from prosecution.

Può essere processato solo per due reati:
He may only be prosecuted for two offences:

attentato alla Costituzione e alto tradimento, nel qual caso è messo in stato di accusa dal Parlamento in seduta comune, poi giudicato dall’Alta Corte di giustizia che comprende 16 giudici eletti dal Parlamento in seduta comune e i 15 giudici costituzionali, dei quali ricordo, 5 nominati da lui.

Quindi in qualche modo il Presidente della Repubblica ha scarsissimi controlli, esercita una grande quantità di poteri ma non ha controlli su eventuali abusi.

Eventuali abusi a meno di non configurare un attentato alla Costituzione non sono perseguibili.
He cannot be prosecuted for any potential abuse of power that doesn’t quite constitute defeating the ends of the Constitution.

Da garante a ingombrante
From guarantor to being awkward

Questo è uno degli aspetti più delicati che pian piano ha prodotto una trasformazione della carica.
This is one of the more delicate aspects that have, bit by bit, brought about a transformation in the role of State President.

In un primo momento il Presidente della Repubblica ha accentuato una sua funzione notarile, non di intervento politico, in qualche modo c’era una sorta di fair play istituzionale che portava il Presidente a guardare con grande attenzione al suo ruolo di arbitro neutrale.
Initially the State President accentuated his notarial rather than political intervention role. Somehow there was a kind of institutional fair play that led the State President to pay careful attention to his role as unbiased referee.

Questo fair play però a cominciare dagli anni 70 è andato via, via declinando e abbiamo avuto Presidenti che hanno usato i loro poteri per diventare un vero e proprio organo di indirizzo politico in qualche caso concorrente o addirittura prevalente sul governo.
However, with effect from the 1970s this role began to decline bit by bit and since then we have had State Presidents that have used their powers to become a veritable political direction body, in some cases competing against or even dominating the government.

Non introduco altri argomenti perché… questo beve dipinto dei poteri del Presidente e delle immunità che lo assistono già dà l’idea dell’importanza della carica.
I won’t introduce any other issues at this point because this brief sketch of the State President’s poker and the immunity that helps him is already enough to give you some idea of the importance of this post.

Per concludere sottolinerei proprio quest’ultimo aspetto:
In conclusion I would however like to highlight this final aspect:

nel tempo la carica è stata esercitata in modi molto diversi, molti poteri che sulla carta sono scritti in modo estremamente generico poi hanno avuto una loro funzione un loro modo di essere esercitati in base alla personalità del singolo Presidente.
over time this role has been exercised in very different ways , many of the powers that are written in an extremely general manner on paper have been used and exercised in different ways depending on the individual personalities of the State Presidents.

Quindi determinante per capire la funzione nel sistema politico del Presidente non è solo quello che c’è scritto nella Costituzione, ma anche le caratteristiche personali del Presidente e soprattutto la situazione particolare in cui si trova storicamente a esercitare il suo mandato, di questo magari parleremo in prossime occasioni.
Therefore, what is vital in terms of understanding the State President’s role in the political system is not only what is written in the Constitution, but also the personal characteristics of the individual that is State President and, above all, the particular situation in which he finds himself historically when exercising those powers, but perhaps we can talk about this at some other time.
