“Vi ricordate quando qualche settimana fa, soltanto per screditare la proposta del M5s sul Reddito di Cittadinanza, il Presidente del Consiglio affermava che il nostro disegno di legge era incostituzionale?
“Do you remember just a few weeks ago when the President of the Council stated that our draft law was unconstitutional? He said that just to discredit the M5S proposal for the Citizens’ Income.

Delle due l’una: o il Premier è ignorante, oppure, mente con l’intenzione di farlo.
Well we’ve got a dilemma here: either the Premier is ignorant, or he was intentionally lying.

>>> A sostenere, infatti, la costituzionalità della proposta del M5s sul reddito di cittadinanza (misura presente, tra l’altro, in tutti i Paesi europei eccetto Italia e Grecia) sono stati due autentici e tra i più noti costituzionalisti italiani, ovvero, l’ex Presidente della Corte Costituzionale, Prof.Paolo Maddalena ed il Prof.Gianni Ferrara, Professore emerito di Diritto costituzionale dell’Università “La Sapienza” di Roma;
To give support to the constitutionality of the M5S proposal about the Citizens’ Income (a measure that is to be found in all European countries apart from Italy and Greece) there are valid Italian constitutionalists who are two of the most famous, namely the former President of the Constitutional Court, Professor Paolo Maddalena and Emeritus Professor of Constitutional Law at Rome’s “La Sapienza” University, Professor Gianni Ferrara.

Il principale quesito sottoposto ai costituzionalisti, per chiarire tutti i dubbi del Premier è stato il seguente:
To clear up all the Premier’s doubts, the question asked of the constitutionalists was as follows:

“E’ vero che il Reddito di cittadinanza del M5s, sarebbe in contrasto con il principio fondamentale, secondo cui l’Italia è una Repubblica democratica fondata sul lavoro?”
“Is it true that the M5S proposal for a Citizens’ Income would be against the fundemental principle that says that Italy is a Republic founded on work?“

Ecco alcuni dei passaggi più rilevanti delle loro risposte:
Here are some of the most relevant parts of their responses:

Prof.Ferrara: “L’affermazione del Presidente del Consiglio contraddice radicalmente il significato autentico dell’articolo 1 della Costituzione, quel solo significato che può avere, ed ha, soggettivandosi in ciascuna delle persone fisiche che compongono l’intera cittadinanza.
Professor Ferrara: “The statement made by the President of the Council is in radical contradiction to the authentic meaning of article 1 of the constitution and the only meaning that it can have, and does have is to subjectivize itself in each of the physical persons making up the enture body of citizens.

È, infatti, proprio dal lavoro, quale fondamento della Repubblica, che una legge istitutiva del “reddito di cittadinanza” trarrebbe non soltanto la costituzionalità, ma la sua doverosità.
It is in fact, actually in “work” as a fundamental basis for the Republic that a law setting up a Citizens’ Income would find not only its constitutionality but also its dutifulness.

Ne sarebbe la conseguenza attuativa per tutte le ipotesi di assenza o insufficienza dell’azione statale volta a promuovere “le condizioni che rendano effettivo” il diritto al lavoro che l’articolo 4 della Costituzione riconosce come uno dei principi fondamentali dell’ordinamento.
There would be implementation consequences for all the hypotheses if the action by the State were absent or insufficient in relation to promoting “the conditions that make the right to work effective” – a right that is found in article 4 of the constitution recognising it as one of the fundamental principles.

Diritto che impone, nell’essere tale, la corrispondenza di un obbligo, che è esattamente quello che la Costituzione intesta alla Repubblica.
The law imposes the correspondence of an obligation which is exactly what the constitution assigns to the Republic.

Il “reddito di cittadinanza” si pone così come diritto che integra la cittadinanza, nei casi e nei modi che il legislatore dovrà stabilire, per assicurare le condizioni minimali di vita nella Repubblica.”
The “Citizens’ Income “ is thus a right that brings together all citizens in situations and circumstances that the legilators must establish, to ensure that there are the minimum living conditions in the Republic.“

Prof. Maddalena: “Non so chi ha potuto affermare una simile sciocchezza.
Professor Maddalena: “I don’t know who could state such a silly idea.

L’art.1 della Costituzione afferma innanzitutto che l’Italia è una «Repubblica», cioè una sorta di famiglia, cui va dato il nome di “Stato comunità”, nella quale l’obiettivo fondamentale, è «lo sviluppo della persona umana» e il «progresso materiale e spirituale della società», e nella quale «la Repubblica riconosce a tutti i cittadini il diritto al lavoro e promuove le condizioni che rendano effettivo questo diritto».
Article 1 of the constitution states first of all that Italy is a «Republic», that is a sort of family that is called a “Community State” in which the fundamental objective is «the development of the human person» and «the material and spiritual progress of society» and in which «the republic recognises the right of all citizens to work, and it promotes the conditions that make this right effective».

Da ciò discende che, se il lavoro manca per ragioni obiettive e non perché il lavoratore non l’abbia cercato, scatta il principio fondamentale di cui al seguente art. 2 Cost., secondo il quale «la Repubblica richiede l’adempimento dei doveri inderogabili di solidarietà politica, economica e sociale»
From this it follows that if there is a lack of work for objective reasons and not because the worker has not looked for work, then this triggers the fundamental principle contained in article 2 of the constitution that says that «The Republic expects that the fundamental duties of political, economic and social solidarity be fulfilled»

In particolare, il disegno di legge sul reddito di cittadinanza del Movimento 5 Stelle mi sembra ottimo;
Specifically, the 5 Star Movement’s draft law on the Citizens’ Income seems optimal to me.

mi appare pienamente conforme a Costituzione.
It appears to be completely in conformity with the constitution.

Anzi mi appare come un preciso adempimento del compito primario che ha la Repubblica di «rimuovere gli ostacoli di ordine economico e sociale, che, limitando di fatto l’eguaglianza dei cittadini, impediscono il pieno sviluppo della persona umana e l’effettiva partecipazione di tutti i lavoratori all’organizzazione politica, economica e sociale del Paese».
In fact it seems to be a precise implementation of the primary duty of the republic to «remove those obstacles of an economic or social nature which constrain the freedom and equality of citizens, thereby impeding the full development of the human person and the effective participation of all workers in the political, economic and social organisation of the country».

Ho apprezzato, in particolare le norme che favoriscono l’avviamento al lavoro e la distinzione tra il tema della «previdenza sociale», riguardante i cittadini in età lavorativa, e «l’assistenza sociale», riguardante i cittadini non più in età lavorativa…Complimenti e auguri”.
I particularly appreciated the measures that facilitate people getting into work and the distinction made between the concept of <>, relating to people of working age, and <> relating to people who are no longer of working age…. Well done – and best wishes.“

Non ci sono più alibi.
There are no longer any excuses.

Il Premier non è più credibile per nessuno e lui, ormai, ne è consapevole.
Nobody any longer believes the Premier to be credible and he knows that now.

Il reddito di cittadinanza è in Senato e non può che essere la priorità dell’intero Parlamento.” M5S Parlamento
