EU researchers and policymakers debate European human rights challenges
Ricercatori e responsabili delle politiche dell’UE discutono sulle sfide per i diritti umani in Europa

During the annual meeting of its General Assembly in Brussels in June 2016, the EU-funded FRAME project hosted a number of roundtable policy debates on the current state of human rights policy in the EU.
Durante l’incontro annuale della sua assemblea generale, tenutosi a Bruxelles a giugno 2016, il progetto FRAME finanziato dall’UE ha ospitato diversi dibattiti politici sull’attuale stato della politica per i diritti umani nell’UE.

The three roundtables, which included a number of high-profile speakers from academia, the European institutions and relevant trade bodies and NGOs, focused took place at the Royal Library of Belgium on 6 June 2016.
Le tre tavole rotonde, che comprendevano una serie di interventi di alto profilo da parte di rappresentanti del mondo accademico, delle istituzioni europee e di organismi professionali e ONG, si sono tenute presso la Biblioteca reale del Belgio il 6 giugno 2016.

The three topics covered were human rights with regards to economic and social rights, the ongoing migration crisis, and terrorism.
I tre argomenti trattati erano i diritti umani in relazione ai diritti economici e sociali, la crisi migratoria in corso e il terrorismo.

Social and economic rights
Diritti sociali ed economici

During the first roundtable, centred on the broader subject of how human rights impact on EU citizens’ overall economic and social rights, many of the speakers placed much emphasis on how the EU’s recent economic crises since the 2008 financial crisis have impacted negatively on human rights within the EU.
Durante la prima tavola rotonda, dedicata all’argomento più generale di come i diritti umani influenzano i diritti economici e sociali dei cittadini dell’UE, molti degli interventi hanno posto l’accento su come le recenti crisi economiche dell’UE, a partire dalla crisi finanziaria del 2008, hanno avuto un impatto negativo sui diritti umani nell’ambito dell’UE.

>>>  Prof. Karin Lukas from the Ludwig Boltzmann Institute, argued that one of the key issues in this regard has been that fiscal decision-making and human rights considerations are not linked at the policy level.
La prof.ssa Karin Lukas dell’istituto Ludwig Boltzmann, ha sostenuto che una delle principali questioni riguardava il fatto che il processo decisionale in materia fiscale e le considerazioni sui diritti umani non sono collegati a livello politico.

She argued that this has been the case in Greece, and that no recommendations on how to guarantee citizens’ economic and social rights were included in the formulation of the country’s various austerity programmes.
Ha sostenuto che questo è successo per esempio in Grecia e che nella formulazione dei vari programmi di austerity per il paese non sono state incluse raccomandazioni su come garantire i diritti economici e sociali dei cittadini.

She suggested that one solution could be for human rights-specific assessments carried out by governments in order to pinpoint specific problems and thus be able to receive the right expertise on how to address them.
Ha suggerito quindi che una soluzione potrebbe essere lo svolgimento di valutazioni specifiche dei diritti umani da parte dei governi, in modo da identificare problemi specifici e quindi poter ricevere la giusta guida su come affrontarli.

Mr Jeroen Jutte, representing the European Commission, responded to criticism regarding the European Semester, the EU’s annual cycle of economic policy guidance and surveillance, by arguing that the programme does place emphasis on social investment and that the key is to find the right balance between fiscal stability and addressing the needs of social hardship.
Jeroen Jutte, in rappresentanza della Commissione europea, ha risposto alle critiche riguardo il semestre europeo, il ciclo annuale dell’UE di orientamento e supervisione della politica economica, sostenendo che il programma dà enfasi all’investimento sociale e che la chiave consiste nel trovare il giusto equilibrio tra la stabilità fiscale e la risposta alle esigenze di rigore sociale.

Moreover, he painted a broader picture, arguing the importance of wider economic trends, such as the growing automation in industry, and whether manufacturing jobs could be maintained as a result of these trends.
In più ha delineato un quadro più ampio, sostenendo l’importanza di tendenze economiche più vaste, come la crescente automazione nel settore industriale e se è possibile mantenere i posti di lavoro nel settore manifatturiero a causa di tali tendenze.

The overall key point taken from the debate was that human rights are fundamentally about individuals and that more concrete steps must be put into action to ensure access to justice with regards to citizens’ social and economic rights.
Il concetto generale che si desume dal dibattito è che i diritti umani riguardano fondamentalmente i singoli individui e che bisogna fare passi più concreti per assicurare l’accesso alla giustizia per quanto riguarda i diritti sociali ed economici dei cittadini.

The migration crisis
La crisi migratoria

In possibly the most heated of the three policy debates, Dr. Thomas Gammeltoft-Hansen, Research Director at the Raoul Wallenberg Institute of Human Rights and Humanitarian Law, stated that some EU Member States have been overwhelmed by the need to ensure the human rights of large refugee populations within their borders and others are ‘doing everything they can to avoid their responsibilities and make themselves less attractive to migrants.’
Nel dibattito forse più accesso dei tre, il dott.Thomas Gammeltoft-Hansen, direttore della ricerca presso l’Istituto Raoul Wallenberg per i diritti umani e il diritto umanitario, ha affermato che alcuni Stati membri dell’UE sono stati sopraffatti dal bisogno di assicurare i diritti umani di numerose popolazioni di rifugiati all’interno dei propri confini e che altri “stanno facendo tutto il possibile per evitare le proprie responsabilità e risultare destinazioni meno appetibili per i migranti.”

Prof.Wolfgang Benedek, a member of the FRAME consortium, outlined how active the project has been in exploring human rights in the context of migration to the EU.
Il prof. Wolfgang Benedek, un membro del consorzio FRAME, ha spiegato quanto sia stato attivo il progetto nello studio dei diritti umani nel contesto della migrazione verso l’UE.

He expanded on the need to modify the Dublin Regulation for asylum claims and his concerns on how the Dublin system would work if some Member States refuse to take on their share of refugees.
Ha parlato inoltre del bisogno di modificare il Regolamento di Dublino per la richiesta di asilo e dei suoi dubbi su come potrebbe funzionare il sistema di Dublino se alcuni Stati membri rifiutassero di ricevere la propria quota di rifugiati.

He stated that financial incentives may be a good start, but argued that there should also be a more comprehensive approach which gives due attention to the human rights aspect, which is not outspoken or evident enough in current EU proposals on how to reform the Dublin system.
Ha dichiarato che gli incentivi finanziari potrebbero essere un buon inizio, ma ha sostenuto che è necessario anche un approccio più completo che dia la giusta attenzione all’aspetto dei diritti umani, e quiesto non è abbastanza esplicito o evidente nelle attuali proposte dell’UE su come riformare il sistema di Dublino.

Another part of the discussion was concerning the difficulty in conducting empirical research with regards to human rights and migration, due to the fact that events on the ground can often move quickly.
Un altro aspetto della discussione verteva sulla difficoltà di condurre iniziative di ricerca empirica nel campo dei diritti umani e della migrazione, a causa del fatto che gli eventi sul campo spesso cambiano rapidamente.

Miss Linda Ravo, representing the European Commission’s DG Justice, explained that with research on the ground, one of the most challenging aspects is gathering data on migrant children, particularly unaccompanied children.
Linda Ravo, in rappresentanza della DG Giustizia della Commissione europea, ha spiegato che per la ricerca sul campo, uno degli aspetti più difficili è raccogliere dati sui bambini migranti, in particolare su quelli non accompagnati.

She stated that the Commission is now developing a comprehensive approach in order to protect migrant children.
Ha dichiarato che la Commissione è impegnata al momento nello sviluppo di un approccio completo per proteggere i bambini migranti.

Human rights and the threat of terrorism
I diritti umani e la minaccia del terrorismo

In the third and final debate, Prof. Elina Pirjatanniemi from Abo Akedemi University in Finland, emphasised the need to maintain a discourse on security from terrorism threats within the democratic arena.
Nel terzo e ultimo dibattito, la prof.ssa Elina Pirjatanniemi dell’Università Abo Akedemi in Finlandia, ha sottolineato l’esigenza di tenere aperto il discorso sulla sicurezza dalla minaccia del terrorismo nell’arena democratica.

She believed that one of the possible ways to do this is through what much of the discussion of the first panel on social and economic rights addressed – in essence, the ability to see human rights from a much broader perspective and to protect fundamental rights as a means to protect against the threat from terrorism.
Ha affermato che uno dei possibili modi per farlo è attraverso quello che era stato discusso nel primo comitato sui diritti sociali ed economici – in essenza, la capacità di vedere i diritti umani da una prospettiva molto più ampia e di proteggere i diritti fondamentali come mezzo per proteggere contro la minaccia del terrorismo.

Finally, much of the discussion in this policy debate was on the importance of data collection as a means to combat terrorism, and whether such collection poses a threat to individual human rights.
Infine la discussione in questo dibattito politico si è spostata sull’importanza della raccolta dei dati come mezzo per combattere il terrorismo e se tale raccolta costituisca una minaccia per diritti umani individuali.

Joe McNamee, Director of EDRi, an NGO that protects digital rights argued that the long-term storage of data is not only pointless but also illegal, even though he has been very worried by EU-level legislative moves in this direction.
Joe McNamee, direttore di EDRi, una ONG che protegge i diritti digitali, ha sostenuto che la conservazione a lungo termine di dati non è solo inutile ma anche illegale, anche se si dichiara molto preoccupato circa gli atti legislativi fatti a livello europeo in questa direzione.

Mrs Annemieke Dokter, representing the European External Action Service (EEAS), agreed and inputted that data collection only makes sense if it is possible to interpret what the data means.
Annemieke Dokter, in rappresentanza del Servizio europeo per l’azione esterna (SEAS), si è trovata d’accordo e ha aggiunto che la raccolta dei dati ha senso solo se è possibile interpretare il significato dei dati.

Overall, it was agreed that there was a fine line to walk between guaranteeing citizens’ human rights and providing security against terrorist threats.
In generale si è concordato che c’è una linea sottile tra il garantire i diritti umani dei cittadini e il garantire la sicurezza contro la minaccia del terrorismo.

The FRAME project is an international research consortium that is focusing on the contribution of the EU’s internal and external policies to the promotion of human rights worldwide.
Il progetto FRAME è un consorzio di ricerca internazionale che si occupa del contributo delle politiche europee interne ed esterne per la promozione dei diritti umani in tutto il mondo.

The project is due to end in April 2017 and has received nearly EUR 6 500 000 in EU funding.
Il progetto si concluderà ad aprile 2017 e ha ricevuto quasi 6,5 milioni di euro di finanziamenti dall’UE.
