Antitrust: Commission introduces new anonymous whistleblower tool
Antitrust: la Commissione crea un nuovo strumento di informazione anonima

A new tool to make it easier for individuals to alert the Commission about secret cartels and other antitrust violations while maintaining their anonymity has been launched by the European Commission today.
La Commissione europea ha varato oggi un nuovo strumento mediante il quale un privato cittadino può segnalarle l’esistenza di cartelli segreti e di altre violazioni delle norme antitrust, mantenendo l’anonimato.

Individuals can now help anonymously in the fight against cartels and other anti-competitive practices.
Un privato cittadino può ora contribuire in forma anonima alla lotta contro i cartelli e le altre pratiche anticoncorrenziali.

These practices include agreeing on prices or procurement bids, keeping products off the market or unfairly excluding rivals and can cause immense damage to Europe’s economy.
Tali pratiche includono gli accordi sui prezzi o sulle offerte nelle gare d’appalto, la mancata immissione dei prodotti sul mercato o l’esclusione indebita dei concorrenti e possono causare danni ingenti all’economia europea.

They can deny customers access to a wider choice of goods and services at reasonable prices, stifle innovation and put companies out of business.
Possono togliere ai clienti la possibilità di accedere a una più ampia scelta di beni e servizi a prezzi ragionevoli, ostacolando nel contempo l’innovazione e condannando determinate imprese alla chiusura.

With our new tool it is possible to provide information, while maintaining anonymity.
Con il nuovo strumento è possibile fornire informazioni mantenendo l’anonimato.

Information can contribute to the success of our investigations quickly and more efficiently to the benefit of consumers and the EU’s economy as a whole”.

Until now, most cartels have been detected through the Commission’s leniency programme, which allows businesses to report their own involvement in a cartel in exchange for a reduction of the fine imposed on them.
Finora è stato possibile scoprire la maggior parte dei cartelli grazie al programma di trattamento favorevole della Commissione, che consente alle imprese di comunicare la propria partecipazione a un cartello in cambio di una riduzione dell’ammenda di cui sono passibili.

The Commission’s new tool gives an opportunity also to individuals who have knowledge of the existence or functioning of a cartel or other types of antitrust violations to help end such practices.
Il nuovo strumento della Commissione offre anche ai singoli cittadini che sono a conoscenza dell’esistenza o del funzionamento di un cartello o di altri tipi di violazioni delle norme antitrust l’opportunità di contribuire a porre fine a tali pratiche.

The new system increases the likelihood of detection and prosecution and so stands to further deter businesses from entering or remaining in cartels or carrying out other types of illegal anti-competitive behaviour.
Il nuovo sistema aumenta la probabilità di smascherare e perseguire le imprese responsabili e, pertanto, costituisce per esse un ulteriore deterrente all’ingresso o alla permanenza in cartelli o all’adozione di altri tipi di comportamenti anticoncorrenziali illegali.

It therefore complements and reinforces the effectiveness of the Commission’s leniency programme.
In tal senso esso completa e rafforza l’efficacia del programma di trattamento favorevole della Commissione.

The new tool – anonymous provision of information
Come fornire informazioni in forma anonima con il nuovo strumento

The new tool protects whistleblowers’ anonymity through a specifically-designed encrypted messaging system that allows two way communications.
Il nuovo strumento protegge l’anonimato degli informatori tramite un sistema di messaggistica criptata specificamente concepito, che consente comunicazioni a due vie.

The service is run by a specialised external service provider that acts as an intermediary, and which relays only the content of received messages without forwarding any metadata that could be used to identify the individual providing the information.
È gestito da un fornitore di servizi esterno specializzato che, agendo da intermediario, si limita a inoltrare il contenuto dei messaggi ricevuti senza trasmettere i metadati, che potrebbero essere utilizzati per identificare l’informatore.

In particular, the new tool:
In particolare, il nuovo strumento:

– as well as allowing individuals to provide information, it gives them the option of asking for the Commission to reply to their messages,
– permette ai singoli cittadini di fornire informazioni, dando loro anche la possibilità di chiedere alla Commissione una risposta ai messaggi inviati;

– allows the Commission to seek clarifications and details,
– consente alla Commissione di chiedere chiarimenti e dettagli;

– preserves the individual’s anonymity through encrypted communications and the use of an external service provider,
– tutela l’anonimato dei singoli cittadini tramite comunicazioni criptate e il ricorso a un fornitore di servizi esterno;

– aims to increase the likelihood that the information received will be sufficiently precise and reliable to enable the Commission to follow up the leads with an investigation.
– intende aumentare la probabilità che le informazioni ricevute siano sufficientemente precise e attendibili, consentendo in tal modo alla Commissione di darvi seguito aprendo un’indagine.

Individuals that are willing to reveal their identity can contact the Commission’s competition department directly through a dedicated phone number and e-mail address.
I cittadini che intendono rivelare la loro identità possono contattare direttamente il servizio della Commissione che si occupa di concorrenza tramite un numero di telefono e un indirizzo di posta elettronica ad hoc.
