European Public Prosecutor’s Office: The Netherlands becomes 21st country to join common efforts to protect EU budget against fraud

European Commission confirms the Netherlands as the 21st EU-Member State to join the European Public Prosecutor’s Office.
La Commissione europea conferma l’adesione dei Paesi Bassi alla Procura europea, che acquisisce così il 21° membro tra i paesi UE.

Today, the European Commission confirmed the Netherlands as the 21st EU-Member State to join the European Public Prosecutor’s Office (EPPO) which will play a key role in fighting crimes against the EU budget such as fraud, corruption, money laundering or serious cross-border VAT fraud above €10 million.
Oggi la Commissione europea ha confermato l’adesione dei Paesi Bassi (21° membro) alla Procura europea (EPPO), che svolgerà un ruolo essenziale nel contrastare i reati contro il bilancio dell’UE, come le frodi, la corruzione, il riciclaggio di denaro e le frodi transfrontaliere in materia di IVA sopra i 10 milioni di EUR.

It will be operational by the end of 2020 in all participating Member States.
La Procura sarà operativa entro la fine del 2020 in tutti gli Stati membri partecipanti.

Commissioner for Justice, Gender Equality and Consumers, Vera Jourová, said:

This is why I urge all remaining Member States to join this essential network in the fight against fraud and corruption, so that we can ensure that every cent of the EU budget is spent to the benefit of our citizens.”

Member States that have not yet chosen to participate in the European Public Prosecutor’s Office can join at any time after the adoption of the Regulation, if they wish to do so.
Gli Stati membri che non hanno ancora aderito alla Procura europea e desiderano farlo potranno aderire in qualsiasi momento in seguito all’adozione del regolamento.

On 14 June 2018, Malta notified the Commission of its intention to participate.
Il 14 giugno 2018 Malta ha notificato alla Commissione la sua intenzione di partecipare.

The Commission is examining this notification in line with the procedure set out in Article 331 TFEU and is expected to take a decision shortly.
La Commissione sta esaminando la notifica in linea con la procedura di cui all’articolo 331 del TFUE e dovrebbe prendere una decisione quanto prima.

Today the Commission has also proposed to the Council of the European Union a list of candidates for the EPPO’s Selection Panel.
Oggi la Commissione ha inoltre proposto al Consiglio dell’Unione europea un elenco di candidati per il comitato di selezione dell’EPPO.

The Selection Panel will consist of twelve members, expected to take up their function in October 2018.
Il comitato sarà composto da dodici membri, che dovrebbero assumere la loro funzione nell’ottobre 2018.

The candidates selected will all have worked as former members of the Court of Justice and the Court of Auditors, as national members of Eurojust, members of national supreme courts or as high level prosecutors and lawyers.
I candidati selezionati sono tutti ex membri della Corte di giustizia e della Corte dei conti, membri nazionali di Eurojust, membri dei massimi organi giurisdizionali nazionali o procuratori e giuristi di alto livello.

The Commission’s selection is based on geographical balance, gender balance and due representation of the legal systems of the Member States participating in the European Public Prosecutor’s Office.
La Commissione opera la sua selezione in base a criteri quali l’equilibrio geografico, l’equilibrio di genere e la rappresentanza adeguata dei sistemi giuridici degli Stati membri che partecipano alla Procura europea.

The Selection Panel will be responsible for drawing up a shortlist of candidates for the position of European Chief Prosecutor, assessing the qualifications of candidates before the appointment by the Council.
Il comitato di selezione avrà la responsabilità di redigere l’elenco ristretto di candidati, in base alla valutazione delle qualifiche, per la posizione di procuratore capo europeo, che verrà poi nominato dal Consiglio.

Contesto

Every year at least €50 billion of revenue from VAT is lost from national budgets all over Europe through cross-border fraud.
Ogni anno i bilanci nazionali europei perdono come minimo 50 miliardi di euro di gettito IVA a causa di frodi transfrontaliere.

This is why, in 2013, the Commission proposed, under the leadership of former Commissioner for Justice, Fundamental rights and Citizenship Viviane Reding, to set up a European Public Prosecutor’s Office. This was then taken forward in June 2017 by 20 Member States through the enhanced cooperation mechanism.
Per questo motivo nel 2013 la Commissione, sotto la guida dell’ex Commissaria per la Giustizia, i diritti fondamentali e la cittadinanza Viviane Reding, ha proposto l’istituzione di una Procura europea, alla quale 20 Stati membri hanno dato vita nel giugno 2017 attraverso il meccanismo di cooperazione rafforzata.

The EPPO will ensure that crimes affecting the EU budget – including fraud, corruption, money laundering and cross-border VAT fraud – can be more effectively and swiftly investigated across the EU.
La Procura europea permetterà di perseguire più efficacemente e prontamente in tutta l’UE i reati che ledono il bilancio dell’UE, tra cui le frodi, la corruzione, il riciclaggio di denaro e le frodi transfrontaliere in materia di IVA.

It will overcome the current shortcomings and tackle fraud involving EU funds of over €10,000 as well as complex cross-border VAT fraud cases, involving damage above €10 million.
Essa sopperirà alle attuali carenze e interverrà nei casi di frode relativi ai fondi UE di entità superiore ai 10 000 EUR e nei casi complessi di frode all’IVA transfrontaliera che comportano un danno superiore ai 10 milioni di EUR.

To do so, the EPPO will work hand in hand with national law enforcement authorities and closely cooperate with other EU bodies, such as Eurojust and Europol.
A tal fine, la Procura europea lavorerà di concerto con le autorità di contrasto nazionali e coopererà strettamente con altri organi dell’UE, come Eurojust e Europol.

In May 2018, the Commission proposed new rules for the European Anti-Fraud Office (OLAF) to become a close partner of the European Public Prosecutor’s Office as well.
Nel maggio 2018 la Commissione ha anche proposto nuove norme per rendere l’OLAF un partner importante della Procura europea.

The Commission decision on the Netherlands’ participation in the European Public Prosecutor’s Office will became applicable 20 days after its publication in the Official Journal.
La decisione della Commissione relativa alla partecipazione dei Paesi Bassi nella Procura europea diventerà applicabile 20 giorni dopo la sua pubblicazione nella Gazzetta ufficiale.
