Wiretapping: silences will not be understood
Pubblico una lettera inviatami da Massimo Donadi, capogruppo alla Camera dell’Italia dei Valori, sul disegno di legge sulle intercettazioni presentato dal Governo.
I’m publishing a letter sent to me by Massimo Donadi, Italia dei Valori’s leader in the Lower House. It’s about the draft law on wiretapping that has been presented by the government.
Lettera che condivido.
I agree with what he says.
“Caro Antonio,
“Dear Antonio,
con il disegno di legge sulle intercettazioni, il Governo ha avverato la profezia di Julius Von Kirchmann: “Un tratto di penna del legislatore e intere biblioteche diventano carta straccia”.
With the government’s draft law on wiretapping a prophecy of Julius Von Kirchmann has come true: “A stroke of the pen by the legislator and whole libraries become waste paper”.
Solo che, in questo caso, a diventare carta straccia sarà la legalità e lo stato di diritto in questo Paese.
It’s just that, in this case, what becomes waste paper is the rule of law and the State in this country that is based on the rule of law.
>>> Con il disegno di legge sulle intercettazioni, il Governo di fatto ha “falcidiato” uno strumento fondamentale nelle mani dei magistrati per tutelare i cittadini di fronte ad ogni forma di criminalità e corruzione.
With the draft law on wiretapping, the government has in fact “cut to shreds” a fundamental tool in the hands of the magistracy to protect the citizens in the face of every form of criminality and corruption.
Per andare oltre ad un’immagine a te cara, questa volta non basta dire che è come togliere il bisturi dalle mani di un chirurgo ma che al chirurgo gli vogliono proprio amputare le mani.
To go beyond that to an image that is dear to yourself, this time it’s not enough to remove the scalpels from the hands of the surgeon, but they actually want to amputate the surgeon‘s hands.
Sono tre i passaggi “perversi” di questo disegno di legge che metteranno a serio repentaglio la sicurezza di milioni di cittadini e che consentiranno alla criminalità organizzata di prosperare indisturbata.
There are three “perverse” passages in this draft law that will put the security of millions of citizens in serious jeopardy and will allow organised crime to prosper undisturbed.
Primo.
First.
Da oggi per i reati puniti con meno di 10 anni le intercettazioni sono state di fatto abrogate perché per poterle disporre occorre di fatto che si sia già provata la colpevolezza dell’indagato.
From today, for the crimes for which the punishment is less than 10 years, wiretapping has in fact been abolished because in order to arrange for wiretapping to be put in place, you need to have already proved the guilt of the person under investigation.
Piuttosto che intercettarlo, dunque, lo si andrebbe proprio ad arrestare.
Rather than do the wiretapping you are thus going to go and arrest him.
Secondo.
Second.
Fissare a 60 giorni il termine massimo per le intercettazioni, significa che, se al 59 giorno, se si scoprono ulteriori complici, tutto viene vanificato.
To fix the maximum time for wiretapping at 60 days, means that if on the 59th day, further accomplices are discovered, the whole thing is thwarted.
Insomma, chi delinque continuerà indisturbato a farlo.
So basically anyone who does wrong will continue to do so undisturbed.
Terzo.
Third.
Se, nei casi di estorsione, il Governo pretende che sia la persona offesa a chiedere le intercettazioni, in realtà come il Sud del nostro Paese, la battaglia contro il pizzo sarà vanificata per sempre.
If, in the cases of extortion, the government demands that it is the victim that must ask for wiretapping, in reality as in the South of our country, the battle against the “pizzo” will be defeated forever.
Per tutte queste ragioni, ritengo che la riforma delle intercettazioni sia un atto di eversione costituzionale, un attentato alla sicurezza dello Stato, una resa definitiva del Paese alla mafia, alla camorra, alla ‘ndrangheta.
For all these reasons, I believe that the reform on wiretapping is an act of constitutional subversion, an attack on the security of the State, a definitive surrender of the country to the mafia, the camorra, and the ‘ndrangheta.
Di fronte a questo scempio, che segna la vittoria di Berlusconi e dei falchi oltranzisti, non ci sono giustificazione degli alleati che tengano.
In the face of this havoc that indicates the victory of Berlusconi and the extremist hawks, there are no meaningful justifications that stand up that the allies can give.
E’ la sconfitta, senza mezzi termini, di Fini, di An, della Lega e di tutti quelli che, a parole, si professano e si dichiarano difensori della legalità.
It is the defeat, without mincing words, of Fini, of AN, of the Lega and all those who by their words claim to be upholders of the rule of law.
E’ il più grande regalo della storia del nostro Stato ad ogni forma di criminalità.
It is the biggest gift in the story of our State to every form of criminality.
Ebbene, di fronte a tutto questo, ci aspettiamo, anzi, diamo per scontato, che le più alte cariche dello Stato, si opporranno a questa tragica scelta.
OK, in the face of all this, we are expecting, in fact, we accept it as a given, that the highest authorities in the State will be opposed to this tragic choice.
Perché questa legge è ancora più grave del lodo Alfano, perché se il lodo Alfano è una norma eticamente vergognosa poiché garantisce l’impunità ad un uomo, questa sulle intercettazioni è socialmente devastante perché compromette la sicurezza e la libertà di milioni cittadini.
Because this law is even more serious than the lodo Alfano, because the lodo Alfano is a regulation that is ethically shameful given that it guarantees the impunity of a man. This law on wiretapping is socially devastating because it compromises the security and the liberty of millions of citizens.
Ed è proprio per questa ragione che siamo convinti che tutte le più alte cariche dello Stato comprenderanno che qui sono in gioco valori fondamentali di fronte ai quali, questa volta, silenzi o i mancati contrasti non saranno compresi in quanto rappresenterebbero un danno per il Paese.
And it is for this very reason that we are convinced that all the the highest authorities in the State will understand that here what is at risk are the fundamental values and in this situation, this time, silences and the failure to speak up against this will not be understood as that would represent damage for the country.
Per il supremo rilievo dei valori in campo, il dibattito intorno a questa legge rappresenterà un punto di svolta nella vita democratica e nel confronto politico e istituzionale del Paese.
For the crucial significance of the values at play, the debate around this law will represent a turning point in the democratic life and in the political and institutional engagement of this country.
Per questa ragione, le uniche posizioni possibili potranno essere quelle di chi sostiene la legalità o di chi la legalità la infrange, di chi questa legge la contrasta e la combatte, nelle forme e nei modi che appartengono al proprio ruolo, e di chi questa legge la consente o la avvalla.
For this reason, the only possible positions could be for those who uphold the rule of law or those who go against it. The positions could be for those who stand up against this law and fight it in the ways that are appropriate to one’s own role, and on the other hand the position of those who agree to this law and who validate it.
Nel mezzo, questa volta, nessuno si potrà collocare.
This time, no one can place themselves in the middle.
Perché questa volta un mezzo non c’è.
Because, this time there is no middle position.
