No to the blog-killer

La Rete è l’ultimo media libero rimasto in Italia.
The Internet is the last communication media that is still free in Italy.

La politica lo sa e non rinuncia a sferrare il suo attacco dopo aver occupato giornali e televisioni.
Politics knows this and is not renouncing its attack after having occupied newspapers and TV channels.

Mi ero dissociato a suo tempo dal disegno di legge Levi-Prodi che prevedeva per i blogger di registrarsi al Registro degli Operatori di Comunicazione (ROC) e l’estensione dei reati a mezzo stampa.
At the time I disassociated myself from the Levi-Prodi draft law that aimed to get bloggers to register with the Register of Communications Operators (Registro degli Operatori di Comunicazione = ROC) and the extension of crimes relating to the press.

The contents of the Levi draft law In relation to the Internet were worthy of a dictatorship.

Luckily the 2007 draft law did not get passed and everything seemed to remain as before.

Senonché il 6 novembre scorso nel silenzio più assoluto questa proposta con un nuovo testo (C-1269) è stata assegnata, in sede referente, alla VII Commissione Cultura della Camera.
But then on 6 November in the most absolute silence, this proposal with new text (C-1269) has been assigned, to the Eighth Culture Committee of the Lower House.

I contenuti e gli attacchi alla libertà di informazione non sono cambiati, eccetto qualche distinguo inutile, operato dallo stesso Levi, presente in questa seconda versione.
The contents and the attack on the freedom of information are not changed, apart from some useless details, put in place by Levi himself, that are present in this second version.

Su questo disegno di legge non ci sarà nessun margine di discussione né con il centrodestra né con il centrosinistra.
On this draft law there will be no discussion margin with either the Centre Right or the Centre Left.

Qualora dovesse passare potrebbe dare come unico risultato la disobbedienza civile.
If it were to get past it could produce civil disobedience as its only result.

“Art. 2. (Definizione di prodotto editoriale).
“Art.2. (Definition of a publishing product)

1. Ai fini della presente legge, per prodotto editoriale si intende qualsiasi prodotto contraddistinto da finalità di informazione, di formazione, di divulgazione o di intrattenimento e destinato alla pubblicazione, quali che siano la forma nella quale esso è realizzato e il mezzo con il quale esso viene diffuso.
1. For the purposes of this law, the term “publishing product” means any product aimed at providing information, training, broadcasting or entertainment and destined for publication, whatever the form used to realize the product and the media used to make the product available.

Qualsiasi blog rientra in questa definizione.
Any blog comes within this definition.

Art. 8. (Attività editoriale sulla rete internet).
Art. 8. (Publishing activity on the Internet)

1. L’iscrizione nel Registro degli operatori di comunicazione dei soggetti che svolgono attività editoriale sulla rete internet rileva anche ai fini dell’applicazione delle norme sulla responsabilità connessa ai reati a mezzo stampa.
1. The act of signing up to the Register of Communications Operators by people who carry out publishing activity on the Internet is relevant to the application of the regulations related to the crimes for the printed word.

3. Sono esclusi dall’obbligo dell’iscrizione nel Registro degli operatori di comunicazione i soggetti che accedono alla rete internet o che operano sulla stessa in forme o con prodotti, quali i siti personali o a uso collettivo, che non costituiscono il frutto di un’organizzazione imprenditoriale del lavoro.”
3. Excluded from the obligation to sign up to the Register of Communications Operators are those who make use of the internet or who operate on it in forms or with products, such as personal websites or for the use of the public, that do not constitute the fruit of an entrepreneurial work organisation.”

E’ chiaro che la legge è stata fatta e modificata da chi non conosce la Rete oppure da chi la conosce troppo bene e proprio per questo la teme poiché la stragrande maggioranza dei blog contiene banner pubblicitari, ad esempio di Google Ads.
It is clear that the law has been done and modified by those who do not know the Internet or by those who know it too well and for this very reason they fear it, given that most blogs contain advertising banners, for example from Google Ads.

Questi blogger sarebbero dunque per l’Agenzia delle Entrate assimilabili ad “attività di impresa”, dovrebbero iscriversi quindi al ROC rischiando di intercorrere in reati di stampa o, se non lo facessero in quelli di stampa clandestina.
These bloggers would thus be for the Tax Collecting Agency, similar to “entrepreneurial activities” and should thus sign up to the ROC thus risking to bump into the crimes of the press or if they don’t sign up bump into the crimes of clandestine printing.

L’Italia dei Valori offrirà tutta l’assistenza legale a chi verrà perseguito per la sua violazione. Italia dei Valori will offer all the legal assistance to those who are prosecuted for such violation.

Le regole vanno rispettate, ma non quelle che mettano a rischio la democrazia e siano palesemente anticostituzionali, e questo perché non sono regole ma abusi e soprusi. Questo disegno di legge è pura censura.
Rules should be respected, but not those that put democracy at risk and that are obviously anti-constitutional. And this is because these are not rules but abuse of power. This draft law is pure censorship.

L’Italia dei Valori si attiverà da subito con una serie di iniziative contro questo disegno di legge liberticida facendo appello anche alle istituzioni internazionali e i media esteri.
Italia dei Valori will get busy straight away with a series of initiatives against this freedom-killing draft law also by appealing to the international institutions and to the foreign media.
